The 8^th March is International Women’s day. The UN declares an International Women’s Day theme for year 2013, it’s “A promise is a promise: Time for action to end violence against women”. For a country that worships Durga and Kali, it’s disgrace to be tagged on number 4 in the world as ‘dangerous for women’. Experts say a woman’s struggle starts from the moment she is inside mother’s womb. I was somewhat lucky because my struggle didn’t start from the womb but started when I was around nine to ten years old. I was surviving molestation from our distant cousin who later ended up marrying my elder sister. It didn’t stop him there, he kept molesting me & threatening me with my father’s & my younger brothers’ life. He served as a Mumbai Police officer between year 1974 and year 2006. I was afraid for my father’s & my brothers’ life so couldn’t do much against him. Around year 1998 my father confronted him for laundering his bribe money through my NRE account. Finally I gathered the courage & filed complaint at Anti-Corruption office around June 1999 against him. My action made him so upset that he openly threatened me with destroying my & my love one’s life. Unfortunately our sister, his wife stood up with him against us.

My younger brother’s (newlywed in February ’1998) wife joined them in harassing my father, my both brothers & me. Around same time my father made living will & disowned our sister from his property. My father’s lawyer leaked this confidential information to our sister & to her husband who gave all of them added motive to harass my father further. They illegally restrained my 86 years old father in his own bungalow between July 2001 and December 2002.  They abused him for 17 months to death & continued abusing my both brothers till date. Thane Police & Thane Court officials refused to help me to stop the abusers. I filed numerous complaints to local Vartak Nager police station & office of Police Commissioner which is in Thane city, state of Maharashtra India. I continued fighting very hard to bring my father’s murderers & my brothers’ abusers to justice.

When I realized that corrupt Thane police are shielding these murderers I escalated complaints to their superiors, the Home minister & Chief Minister. Thane police commissioner who later was promoted as Mumbai Commissioner in June 2008 refused to investigate my father’s murder in spite of knowing that the murder investigation orders are issued by Director General of Police, Home Minister , Chief Minister & Chief Justice of Maharashtra between May 2005 & July 2009. Thane police team up with Thane court Judge & tried to shut me up by arresting my tortured turned Schizophrenic brother & putting him Thane jail for 3 weeks between 25 th September’2008 & 19^th October’2008.

I flew all the way from Washington while interrupting my Cholesteatoma treatment & brought my brother out of jail. The angry Thane police filed false FIR against me & tried to put me behind bars under theft charges. I came back to Washington & filed detail complaint to India Ambassador Washington DC office around August 2009. Ambassador office sent my father’s murder investigation order to Chief Secretary of Maharashtra & Director General Police on 29^th September’09 which reached to Addi Chief Secretory of Home Department Mumbai office in VIP Status on 30^th September. If the said investigation would have taken place in Oct’09, then Mumbai CP who was dreaming to become DGP & Mumbai joint CP Crime would have been in big trouble because they were protecting my father’s murderers & our abusers. These high rank police officers manipulated Ambassador Officials & instead of acting on said investigation order they filed false complaint at US Homeland Security Department on 1^st October’2009 informing them that I am planning to commit suicide at India Ambassador Washington DC office. My family & I had to go through intense FBI investigation here in Seattle.

Fortunately I could prove my innocence to FBI so they let me go but kept the investigation in unresolved status. It will stay open until Ambassador Officials would accept their wrong doing & release the Apology letter to US Homeland Security Department.  I filed detail complaint along with FBI investigation report to Prime Minister & Bombay High Court Judicature. PMO ordered CBI on 13/10/11 & Judicature ordered CBI around December’2011 to investigate my father’s murder & money laundering charges. The irony is, CBI Mumbai officials successfully put PMO & Judicature order under the rug.

After experiencing Ambassador Official’s inhuman actions & Maharashtra Home Ministry, Police, CBI’s unethical, illegal approach towards above mentioned investigation orders, I reached to Bombay High Court with 2 different petitions. The Writ petition 760/2011 was against External Affairs Ministry & the hearing of said petition took place front of Chief Justice Maharashtra Mr. Mohit Shah’s court. Surprisingly External Affairs Ministry accepted their officials’ wrong doing & released the Apology letter for me & for FBI almost immediately.

Instead of forwarding the copy of that letter to my lawyer, Justice Mr. Shah bargain with me in his open court on 11/7/2011 & on 12/7/2011 in exchange of the said Apology letter. He threatened me openly on both said dates when I refused to surrender my compensation prayer in exchange of the said Apology letter. He stated that he will make me face the Sevier consequences for not accepting his suggestion of surrendering my compensation request. He still is illigaly holding the said Apology letter in his custody illegally. I did file the detail complaint dated 5/7/2012 & the evidences of his corrupt practices to the President. The office of Chief Secretary of Maharashtra received regarding investigation order around Oct’12 from the President office which was forwarded to High Court for further investigation but till date no Authority of Maharashtra dare to investigate Justice Mr. Shah.

My another Criminal writ petition 1551/2012 was filed  in expectation of getting expedite justice against Home Ministry & involved investigating agencies based on Constitution of India Art.-21”Life” and “Personal Liberty” and Arts.21,32 and 226-“Human Rights”-Fair and impartial investigation”. The submitted Exhibits were very evident to prove the number of crimes these murderers, abusers & their protectors committed against my father & continued committing against my brothers & me which clearly comes under IPC section 300 (culpable homicide of the first degree), 120-B(criminal Conspiracy), 420(cheating), 383 (extortion), 467 (forgery), 471(using as genuine a forged document) , sections between 191 &  221(false evidences & offenses against Public Justice), sections between 328 & 348 (grievous hurt, wrongful restraint & wrongful Confinement), Violation of Mental Health Act (1987) & violation of my constitutional Rights & Human Rights Act (1993).

I was shocked to witness that in spite of having so many evidences against each & every accused in the petition, the brilliant High Court Judge like Mr. Abhay Oak for some reason chose to shield all of them. He served very confusing judgment on 30^th November 2012 which is in my favor but same time all these accused also remained untouched. This judgment definitely needs to get reviewed by Supreme Court Chief Justice. The escalation of my mental, emotional torture has made me physically fragile. I am hoping that after reading my ordeal group of people, activists from my home country will come forward to help this daughter, sister, mother to meet the below requests.

1)      Having India External Affairs Ministry officials clearing my name from US Homeland Security Department & India Ambassador Washington DC office file ASAP.

2)       Having Chief Justice of Maharashtra Mr. Mohit Shah releasing the External Affairs Ministry’s Apology letter which they have submitted in his Court on 11/7/2011.

3)      Bringing my Dad’s murders, our abusers and their protectors to justice in time bounding manner with un-bailable arrests.

4)      Rescuing my brothers’ from their abusers in expedite manner and getting them urgent Psychiatric help.

5)      Taking disciplinary actions against Chief Justice of Maharashtra Mr. Mohit Shah for openly adopting corrupt, illegal practices in violating my Human & Constitutional Rights in his court on 11/7/11 & on 12/7/2011 & further.

To be ever able to understand and conceptualize the term ‘feminism’ one needs to understand patriarchy. Patriarchy literally means ‘the rule of the father or the patriarch’ and was originally used to describe a specific type of male dominated family. Now it is used more generally to refer to male domination. Patriarchy is both a social structure and an ideology, a belief system according to which men are superior. And several aspects of a woman’s life-productive, mobility, sexuality, property and economic resources or even reproductive, are under patriarchal control. And it was to challenge such belief system that ‘feminism’ came into being. Feminism is about challenging this patriarchy which affects one and all whether we realise or not, confront or not. Feminism is about changing the gender roles, sexual norms, and sexist practices that punish you if you are a deviant. Feminists and women’s rights activists believe that gender sensitization is necessary is at all levels. Agree to that! But we also believe that gender training and sensitisation doesn’t merely imply understanding of the related concepts but also internalising them and using this understanding to transform our own ways of thinking and behaving.

Now the question lies “Who really needs feminism?” When in a country like ours you are considered a loser if you are 25+ and don’t have a husband and kids. You need feminism. When you are ashamed to tell your parents that you are majoring in gender studies. You need feminism. When you are discouraged to be a sports reporter because ”you don’t know about sports.” You need feminism. When you aren’t confident to express your body art and modification because it doesn’t fall in the social norm. You need feminism. We women need feminism because we still believe that “we are house wives and not home makers.” We all need feminism because the worst thing you can call a man is a woman and a woman, an animal.

While we all know that women are the ones who fall into ”oppressed” category and surely need to support feminism, few of us are aware that patriarchy also harms men. Yes, it does! And this is how:

Men are also pushed into conforming to their traditional gender roles and socially punished when they don’t.  For example, men are expected to not express their feelings because real “men don’t cry”.  They’re socially encouraged to only express their fear, pain, and stress in the form of anger and violence.  Another example, is how due to traditional gender roles, society thinks women are automatically better parents than men, despite the numerous examples of bad mothers and great fathers.  Feminism believes each person should stand on their own merit – not by how much they conform to social norms and ideals.

Feminism is as much for men as it is for women in order to free them from the sexist and oppressive beliefs that they don’t want to have. So next time your man helps you out in the kitchen don’t be alarmed. He is just being a real man!

हर साल की तरह आज विमेन्स डे है. पर सही मायनों में विमेन्स डे का मतलब क्या है? क्यों हम हर साल 8 मार्च  की तारिख को महिला दिवस के रूप में मनाते हैं? मैं स्वयं महिला होकर आज तक इस बात की गहराई में नहीं जा पाई.

महिला दिवस पर महिला नाम का बखान कर उनको इस बात का अहसास दिलाने की वह मां, बहन, बेटी के रूप में याद की जाती है. वह जीवन संगनी है और दो परिवारों के बीच एक सेतु की तरह है और उसके अलावा समाज में कब और किस रूप में याद की जाती है. शायद तब जब कन्या भू्रण हत्या कर लड़कों की अपेक्षा लड़कियों की औसतन संख्या आधी हो जाती है. तब जब महिलाओं को दहेज के नाम पर मार पीट कर जला दिया जाता है. सर्दी की ठिठुरती रात में गर्भवती महिला को घर से निकाल दिया जाता है. तब जब समाज के रक्षक पुलिस ही सरेआम औरत की लूटती इज्जत को बचाने के बावजूद अपनी हर रात थाने में रंगीन करते हैं. तब जब नाबालिक लड़की मां बन जाए और उसे समाज से दुत्कार कर निकाल दिया जाए. तब जब दफ्तर में उसका बॉस नौकरी का हवाला दे कर हर पल उसका मानसिक व शारीरिक शोषण करे. या तब जब 5-6 लोग मिलकर उसका गैंग रेप करके मरने की हालत में छोड़ दें.

आखिर इन सबके अलावा औरत का कौन सा रूप है, जो उसे औरत होने का अहसास कराता है. आखिर हम महिलाओं का औचित्य ही क्या है? हर धर्म, हर जाति में अमीर से लेकर गरीब हर लड़की को पैदा होने के बाद से यही सिखाया जाता है कि शादी के बाद सबकी सेवा करना, पहले घर के सभी सदस्यों को खिलाना फिर स्वयं खाना, सास कुछ भी बोलें पलट कर जवाब मत देना और न जाने ऐसी तमाम दादी-नानी के नुस्खे, जिसका पालन करते-करते औरत मर जाती है और खुद दूसरों के सुख के लिए हर पल बलि का बकरा बनती है.

पल-पल हलाल होने के बावजूद भी लोगों को उसके समर्पण का अहसास तक नहीं होता. आधुनिकता के दौर में गांव तो क्या शहरों की भी अधिकांश महिलाओं को महिला दिवस के बारे में आज तक कुछ नहीं पता. उन्हें पता है तो सिर्फ करवाचौथ, सकटचौथ और न जाने ऐसे कितने व्रत जो वह अपने पति, पुत्र और परिवार के सुख-सामथ्र्य की मंगल-कामना के लिए करती है.

क्या आपकी नज़रों में सही मायने में महिला दिवस का कोई औचित्य है? क्या महिलाओं के नाम दिवस करने से उसकी समस्याओं का समाधान हो जाएगा? या फिर जो महिला रोज़ अपने शराबी पति से पीटकर उसके शराब के पैसे के लिए न चाहते हुए अपना शरीर तक बेचने पर मजबूर होती है, उसके लिए महिला दिवस का क्या अर्थ?

माना कि महिला दिवस समाज का बनाया गया एक दिन हो सकता है. वो दिन जिस दिन हर रेडियो चैनल पर महिलाओं के लिए गाने बजें, बड़ी-बड़ी फिल्म जगत की महिलाएं गुलाबी कपड़े पहनें अपने लाखों रूपयों के  ठुमकों पर ओरों का मनोरंजन करें पर उन महिलाओं का क्या जिन्हें इसी समाज ने विधवा, तलाकशुदा, बलात्कार पीड़िता या और कुछ कारणों का हवाला देकर अपनी नज़रों से दरकिनार कर दिया है.

महिला को जन्म के बाद से लेकर मृत्यु तक समाज के नियमों, तौर तरीको से रहना पड़ता है. यहां तक कि हिन्दू धर्म में कन्या, विवाहिता अथवा विधवा महिला के अंतिम संस्कारों का प्रावधान तक अलग है. शराबी पति के किडनी खराब होने, सड़क दुर्घटना होने या किसी भी आकस्मिक मृत्यु के शिकार होने पर समाज द्वारा उस महिला को कुलच्छनी तक घोषित कर दिया जाता है. अगर पति के अत्याचारों से परेशान हो वह तलाक ले लेती है, तो यही समाज उसके चरित्र पर अंगुली उठाता है.

अगर बलात्कार हो जाए तो हमारा समाज लड़की के कपड़े, ऑड टाइमिंग्स की बात करता है. पर उन 2 साल से 6 साल की बच्चियों का क्या कसूर, जिन्हें अभी ठीक से बोलना तक भी नहीं आया? फिर यह समाज कहां चला जाता है?

क्या महिला शब्द और उसकी तस्वीर सरकारी कलैंडरों, पोस्टरों में शिक्षा का अधिकार या जननी सुरक्षा अधिकारों के नाम पर सुशोभित करने के लिए हैं? महिला एवं बाल विकास मंत्रालय जैसे राष्ट्रीय महिला आयोग के दफ्तरों के कागजों तक सीमित है? या फिर वस्तु निर्यात के लिए शेविंग क्रीम, साबुन, कार यहां तक की पुरूषों के इस्तेमाल करने वाले कंडोम के प्रचार तक में महिलाओं की जगह सीमित है?

देश की लगभग 50 फिसदी से ज्यादा महिला अनपढ़ हैं. उसे सिर्फ पति, परिवार और दो जून के खाने के अलावा कुछ नहीं पता. उसे इतना भी नहीं पता कि अगर उसके साथ कोई मारपीट या बलात्कार कर दे तो उसे पुलिस के पास भी जाना होता है.

यही नहीं, देश की शिक्षित महिलाएं जो 50 फिसदी हैं उनमें से भी 30 प्रतिशत महिलाओं को कानून तो  पता है पर कानूनों पर उचित कार्रवाई के बारे में नहीं पता. उसे इतना तो पता है कि परेशानी में पुलिस स्टेशन जाना है पर उसे एफआईआर और एनसीआर के बारे में नहीं पता. उसे अपने अधिकारों के बारे में पूर्ण जानकारी तक नहीं.

महिलाओ के नाम दिवस करने से या उनके नाम आरक्षण की मांग करने से देश की महिलाओं की स्थिति में सुधार  होना ऊंट के मुंह में जीरे के बराबर होगा. महिलाओं को शिक्षा, रोज़गार, सुरक्षा, सशक्तिकरण, कानून और उनके  अधिकारों की ज़रूरत है. ज़रूरत है तो सम्मान की, बराबरी के दर्जे की. समाज से निकालने की अपेक्षा उन्हें पुनः सम्मान पूर्वक अपनाने की, क्योंकि औरत से ही परिवार बनता है.

एक ओर तो देश आधुनिकता की ओर अपना परचम फैला रहा है. कोई क्षेत्र ऐसा नहीं, जहां महिला ने अपनी छाप न छोड़ी हो. राजनीति, सेना, विज्ञान एवं तकनीकि, फैशन जगत, आईटी क्षेत्र यहां तक की चांद पर महिलाएं अपनी  अनूठी पहचान बना चुकी हैं. आज वह पुरूषों के साथ कंधे से कंधा मिला कर चल रही हैं. पर फिर भी ज़रूरत है तो लोगों की मानसिकता बदलने की, जो उंचे पदों पर बैठी महिलाओं से लेकर आम महिलाओं के प्रति संकीर्ण सोच  रखते हैं. महिला को मात्र भोग की वस्तु समझते हैं. पर वो भूल जाते हैं कि नारी अब अबला नहीं रही. एक अकेली औरत पूरे घर को क्या पूरे देश को संभाल सकती है.

मात्र 8 मार्च को महिला दिवस मनाने भर से ही इस दिन की सार्थकता सिद्ध नहीं होगी. एक दिन की अपेक्षा प्रत्येक दिन को महिलाओं के सम्मान के प्रति समर्पित करने से समाज में बुराईयों पर काबू पाया जा सकता है. समाज मेरे,  आपसे और हमारे घरों से ही बनता है. और यह तभी संभव होगा जब आप और मेरे जैसे प्रत्येक प्राणी मिलकर  आज प्रण करेंगे कि महिलाओं को हर रूप में सम्मान देंगे. कन्या भ्रूण हत्या का पूरजोर विरोध कर अपनी बच्चियों को शिक्षा का अधिकार देंगे.  और सच तो यह है कि देवी सिर्फ मंदिरों में नहीं हमारे घरों में, हमारे समाज में बसती है.

इस सच से आप इंकार नहीं कर सकते कि देश का कोई भी कानून 100 फीसद सफल नहीं है, जब तक कि इसके लिए 100 फीसद प्रयास नहीं किया जाए. इस बात से भी आप इंकार नहीं कर सकते कि धीरे-धीरे महिलाओं में जागृति आ रही है. महिलाएं पहले की अपेक्षा अब ज़्यादा सशक्त हैं. जो महिला कल तक घूंघट काड़ कर भी निकलने में कतराती थीं, वोट करने का सलीका नहीं पता था. आज वो महिला चुनाव लड़ती है (भले ही एक पुरूष उसके पीछे हो). और न सिर्फ चुनाव लड़ती है बल्कि जीतती भी है. यह अलग बात है कि जीत के बाद भी पुरूष ही उसका लाभ उठाते हैं. उसकी वजह हमारा समाज है, समाज में सदियों से चली आ रही प्रथाएं हैं. इनको सबको बदलने में समय तो लगेगा ही.

गांव की बात करें तो जहां पर महिलाएं अपने पति, पिता या ससूर के सामने बैठ नहीं सकती थीं, उससे पहले खाना नहीं खा सकती थी. वहां उस महिला को हमारे देश के संविधान व कानून ने वो शक्ति दी है कि वो प्रधान कहलाती है. यानी हम देखें तो उस पुराने सोच को बदलने में समय ज़रूर लग रहा है, लेकिन बदला नहीं है, ऐसा नहीं कहा जा सकता.

एक महिला चुनाव जीत कर आती है तो पहले झिझकती है कि कुर्सी पर कैसे बैठे? ससूर खड़े हैं, पति खड़ा है, यानी पहली बार संकोच करती है लेकिन जब दुबारा चुनकर आती है तो उसमें ज़बरदस्त कॉंफीडेंस आ जाता है. काफी कॉंफीडेंस के साथ अपनी कुर्सी पर जाकर बैठेगी, क्योंकि अब तक वो अपने अधिकार को जान चुकी होती है.

मेरा मानना है कि समय के साथ चीज़ें बदलती हैं. और आज महिला सशक्तिकरण की लहर चल रही है. आप देखेंगे कि आने वाला समय महिलाओं का ही होगा. जहां तक महिलाओं के उत्पीड़न की बात है तो उस  उत्पीड़न के लिए ज़ाहिर सी बात है कि जो उत्पीड़न कर रहा है, वो ही सबसे ज़्यादा ज़िम्मेदार है. लेकिन उससे ज़्यादा ज़िम्मेदार हमारा समाज है. किसी और की बेटी के साथ कुछ होता है तो हमें कोई फर्क नहीं पड़ता. लेकिन जब हमारे घर-परिवार में बीतता है तब हम जागते हैं. हमें यह सोच अब बदलना होगा. उत्पीड़न किसी के साथ हो, हमें बोलना पड़ेगा. समाज को कानून के प्रति जागृत करने होगा. और जब जागृति आएगी तो समाज की तमाम कुरीतियां स्वयं ही समाप्त हो जाएंगी.

एक सच्चाई यह भी है कि हमांरा समाज आज भी पुरूष प्रधान समाज है. इसे बदलने की आवश्यकता है. क्योंकि समाज का पुरूष प्रधान होना भी महिला उत्पीड़न का सर्वश्रेष्ठ कारण है. राष्ट्रीय महिला आयोग की सोच है कि ग्रामीण अंचलों में पहुंचने की है. शहरों में लोगों को कुछ हद तक तो अपने अधिकार व कानून पता हैं, लेकिन छोटे शहरों में जहां महिला उत्पीड़न सबसे ज़्यादा होता है और किसी को कानून व अपने अधिकारों की कोई जानकारी नहीं है. बड़े शहरों में तो सामाजिक संस्थाएं लोगों को जागरूक करने का कार्य कर रही हैं लेकिन गांवों में जागरूकता फैलाने वाला कोई नहीं है. ऐसे में हमारी व आपकी ज़िम्मेदारी बनती है कि छोटे शहरों व गांवों में भी लोगों को उनके कानून व अधिकारों के प्रति जागरूक करें. और वैसे भी महिलाएं शक्ति का दूसरा रूप हैं, उसे बस मालूम होना चाहिए कि उसके अधिकार क्या हैं, फिर तो अपने आप ही सशक्त हो जाएगी.

जब हम दिल्ली में बैठकर बात करते हैं तो हम सिर्फ 20 फीसदी लोगों का ही ख्याल करते हैं. 80 फीसदी आबादी तो ऐसे ही छूट जाती हैं. यह 80 फीसद आबादी वो है जिसे पता ही नहीं कि कानून क्या होता है? और उनके लिए क्या कानून इस देश में है?

और सबसे बड़ी बात यह है कि जो कानून इस देश में है, उनमें काफी पेचीदगियां हैं क्योंकि ज़्यादातर कानून ब्रिटिश के ज़माने के हैं. उनमें अब बदलाव की ज़रूरत है. और बदलाव सिर्फ सिविल लॉ में ही नहीं, बल्कि मुस्लिम पर्सनल लॉ व हिन्दू पर्सनल लॉ में भी बदलाव की दरकार है. यह कितना अजीब है कि महिला पहले उत्पीड़न का शिकार होती हैं और जब वह कानून का सहारा लेती हैं तो और भी ज़्यादा उत्पीड़ित होना पड़ता है. सबूत इकट्टा करते-करते पुराने ज़ख्म भर जाते हैं और नए ज़ख्म पैदा हो जाते हैं.

और उससे भी बड़ी बात यह है कि सिर्फ कानून बना देना ही सबकुछ नहीं है. बल्कि हमें यह भी देखना होगा कि उसका पालन कितना हो रहा है? सरकार को यह भी सोचना होगा कि यह कानून देश के हर नागरिकों तक कैसे पहुंचे? उसका पालन कैसे हो? उसकी सुनवाई कौन करे? हमारे देश का हाल तो यह है कि कानून पालन कराने वाले ही कानून का उल्लंघन करते हैं. महिलाओं का सबसे ज़्यादा शोषण यही करते हैं. हमारी प्रशासनिक व्यवस्था भी बड़ी अजीब है. महिला पुलिसकर्मी भी उत्पीड़न की शिकार हैं.

आप हमें बता दीजिए कि क्या कोई महिला शाम 5 बजे के बाद किसी पुलिस स्टेशन में जाने की हिम्मत कर सकती है? शायद नहीं! और शाम व रात की बात कौन करे दिन में भी कोई महिला पुलिस थानों में नहीं जा सकती. एक सच्चाई यह भी है कि गांव में कई रेप के मामले इन्हीं पुलिस चौकी में हुए और इन्हीं कानून के रखवालों ने किए हैं. क्या कभी आपने इनके बात करने का लहज़ा देखा है?

सच तो यह है कि पुलिस के लोगों को बात करने का सलीका नहीं मालूम… वजह यह है कि पुलिस में बहाली शारिरीक योग्यता के आधार पर होती है न कि शैक्षणिक योग्यता के आधार पर. सिर्फ आईएएस व आईपीएस की बहाली में ही शैक्षणिक योग्यता देखी जाती है. अब ज़रा सोचिए कि यह आईएएस और आईपीएस जनता को हैंडिल तो करते नहीं. जनता को हैंडिल तो वही मैट्रिक या आठवीं पास हवलदार करता है. उस बेचारे को तो खुद ही नहीं पता  होता कि कानून क्या है? जितना उसे ट्रेनिंग में बता दिया जाता है, उससे ज़्यादा वो कुछ भी नहीं जानता. तो ऐसे में ज़रूरत इस बात की है कि पुलिस में बहाली शैक्षणिक योग्यता के आधार पर हो न कि शारिरीक योग्यता के आधार पर. और शैक्षणिक योग्यता कम से कम ग्रेजुएशन रखी जाए.

भारतीय सेना में रह कर देश की सेवा करने का मौका मिला. राष्ट्रीय मानवाधिकार आयोग में भी अपनी सेवाएं देते हुए अनेक महिलाओं संबंधित समस्याओं को जाना उसे निपटाने में भी महिलाओं की कोशिश की. साथ  ही कई समाजसेवी संगठनों के साथ मिलकर महिलाओं में जागरूकता और सशक्तिकरण का प्रयास चल रहा है. देश में महिलाओं के कानूनों की लंबी लिस्ट है, पर उन कानूनों का पालन करना सिर्फ सरकार की ही जिम्मेदारी नहीं, विपरित  इसके कानून हमारे घरों से ही टूटते हैं. दूसरे की ओर मुंह ताकने के बजाय कानून का पालन करने वाले हम क्यों नहीं हो सकते हैं?

अगर आप और हम चाहें तो महिलाओं के साथ हो रही हिंसा का शुरूवाती दौर में खातमा कर सकते हैं. दहेज प्रथा हमारे घरों से ही शुरू होती हैं, घर के लोग ही छोटी-छोटी बातों पर दहेज के नाम पर ताने देने लगते हैं, रिश्तों में इतनी कड़वाहट हो जाती है कि हार कर महिला को तलाक या आत्महत्या का रास्ता चुनना पड़ता था. पढ़ी लिखी महिलाओं की सोच काफी हद तक संकीर्ण होती है पर इसके लिए सभी महिलाओं का शिक्षित का होना भी बहुत ही जरूरी है. लेकिन ऐसा भी देखने में आया है कि देश में अनेक महिलाएं शिक्षित हैं, फिर भी वह अपने हक की लड़ाई लड़ने में विफल रहती हैं क्योंकि इसका मूल कारण है महिलाओं में कानून की जानकारी का अभाव है.

हमें शिक्षा के साथ-साथ महिलाओं में कानूनी शिक्षा को भी अनिवार्य रूप से शामिल करना चाहिए. महिलाओं को उनके हक के बारे में पता होना चाहिए वो चाहे घरेलू हिंसा, यौन उत्पीड़न, पैतृक संपत्ति में बराबरी का हिस्सा या राइट टू  डिगनटी ऑफ वर्किंग प्लेस ही क्यों न हो. शिक्षित होने के साथ-साथ रोजगार का होना भी महिलाओं में अति  आवश्यक है. कामकाजी महिला होने के नाते वह सामाजिक गतिविधियों को आसानी से समझ सकेगी, रास्ते में आने
वाली चुनौतियों का सामना करने के साथ वह अपने निर्णय स्वयं लेने में भी सक्षम होगी.

आज महिलाएं तलाकशुदा या विधवा होने के बाद भी समाज में पूरे सम्मान के साथ अपना पचरम लहरा रही हैं, ऐसा कोई क्षेत्र नहीं जहां महिलाओं  की पहुंच न हो. अपने कार्यकुशलता के कारण ही अपनी अलग पहचान बनाए हुई हैं. अनेक महिलाएं ऐसी भी हैं जो पति से प्रति माह गुजारा भत्ता लेने के बजाय उसकी प्रताड़ना से परेशान हो शीघ्र ही तलाक लेना चाहती हैं. वो अपनी  शिक्षा या हूनर के बदोलत इतनी सक्षम है कि अपने लिए कमा कर खा सकती है.

आज के समय में समाज में परिवर्तन तो आया है पर फिर भी समाज के नजरियें में और परिवर्तन की जरूरत है. आज के दौर में गांव या मध्यम  वर्ग की महिला भले ही चाहे वूमन्स डे न जानती हो पर फिर भी उसे इतना जरूर पता है कि घरेलू हिंसा क्या होती है, उसे अब पुलिस स्टेशन और पुलिस के बारे में भी जानकारी होने लगी है. लेकिन बढ़ती जनसंख्या के चलते कानून भी कई मामलों में चाह कर भी कुछ नहीं कर पाता, अदालत में न जाने कितने केस पैंडिंग है, जिन पर सुनवाई की तारिख आते आते वो शख्स गुजर जाता है, शायद यह सब बढ़ती जनसंख्या के कारण है. अगर जनसंख्या काबू में  रहेगी तो कानून व्यवस्था और अधिक अपना शिकंजा कस सकेगा. औरत को समझना चाहिए कि बच्चा सिर्फ भगवान  की देन ही नहीं, उसकी भी देन है उसे अधिक बच्चों को जन्म देने का विरोध करना चाहिए. पढ़ी लिखी महिला ही समाज में परिवर्तन ला सकती है। छोटी बच्चियों को अपने घरों में बर्तन मांजवाने के बजाय शिक्षा देना चाहिए.

‘महिला सशक्तिकरण’ और ‘सूचना का अधिकार’ दो अलग-अलग विषय हैं, पर इन दोनों में करीब का रिश्ता है. अबला नारी को सबल बनाने का कार्य सूचना का अधिकार ही कर सकता है. बशर्ते कि महिलाएं इस अधिकार का इस्तेमाल अपने विकास व रोज़मर्रा के कामों को कराने और अपने साथ हो रहे ज़ुल्म व अत्याचार के खात्मे के लिए करें. ऐसा महीं है कि महिलाएं इसका इस्तेमाल नहीं कर रही हैं, बल्कि इसका इस्तेमाल करके फ़ायदा भी हासिल कर रही हैं. इस सत्य को आगे की कहानियों से बखूबी समझा जा सकता व देखा जा सकता है कि किस प्रकार हिंसा वर्जनाओं की शिकार सभी वर्गों की महिलाएं सूचनाधिकार द्वारा इंसाफ़ पा सकती हैं.

“दक्षिण दिल्ली के शेख़ सराय इलाक़े की एक झुग्गी-बस्ती में रहने वाली अशरफी देवी उन करोड़ों वंचितों में से एक नाम है, जिन तक पहुंचने से पहले ही सरकार की तमाम योजनाएं दम तोड़ देती हैं. लेकिन पति की असमय मौत फिर अपने दोनों बेटोंके नाता तोड़ लेने के बाद अशरफ़ी देवी का एकमात्र सहारा ये सरकारी योजनाएं ही बची थीं. अनपढ़ अशरफ़ी ने किसी आदमी की मदद से विधवा पेंशन आवेदन समाज कल्याण विभाग के सरकारी दफ़्तर में जमा करा दिया.

वह इस सपने में थी कि पेंशन मिलने पर बाकी की ज़िन्दगी आराम से गुज़र जाएगी, लेकिन इस सपने का सच होना इतना आसान न था. क्योंकि साल भर वह सिर्फ एक से दूसरे, दूसरे से तीसरे बाबू के मेज़ पर चक्कर लगाती रही. लेकिन फायदा कुछ भी नहीं. बल्कि अंत में उस बेसहारा को यह बता दिया गया कि उसका आवेदन खारिज कर दिया गया है.

कुछ दिनों के बाद उसे एक बार फिर पता चला कि दिल्ली नगर निगम में भी विधवा पेंशन देने का प्रावधान है. अशरफ़ी ने एक बार फिर आवेदन किया, लेकिन यहां भी सब कुछ पहले की तरह ही हुआ. अंततः अशरफी ने ‘सतर्क नागरिक संगठन’ की मदद से सूचना के अधिकार का प्रयोग किया और सूचना मिली कि उसकी पेंशन की अर्ज़ी 6 महीने पहले ही मंज़ूर कर ली गई है. पत्र के साथ ही उसे 6 महीने की पेंशन का चेक भी मिल गया.”

“दिल्ली के कल्याणपुरी इलाक़े में झुग्गियों में रहने वाली रमाबाई अपना आय प्रमाण पत्र बनवाने के लिए 6 महीने तक कार्यालय का चक्कर लगा-लगाकर थक चुकी थी, लेकिन जब उसने ‘परिवर्तन’ संस्था की मदद से सूचना के अधिकार के तहत आवेदन किया तो महज़ 10 दिनों के भीतर उसे आय प्रमाण पत्र दे दिया गया, यही नहीं उसे अंत्योदय कार्ड बनने में हो रही देरी को भी सूचना के अधिकार से सुलझा लिया.”

“बंग्लोर में रहने वाली जयलक्षम्मा के पति आयकर विभाग से रिटायर हुए थे और उन्हें 1975 से पेंशन मिल रही थी. पति के मौत के बाद जब उन्होंने पेंशन अपने नाम किए जाने का अनुरोध बैंक को दिया तो उन्हें कर्मचारियों ने परेशान करना शुरू किया. कभी कागज़ों में कमी बताई, तो कभी उनकी असली प्रति लेकर आने के नाम पर उन्हें टाल दिया जाता. अंततः एक सामाजिक कार्यकर्ता के मदद से उन्होंने सूचना के अधिकार के तहत आवेदन किया. इस आवेदन के जमा होने के 15 दिन के अंदर ही पेंशन के तमाम कागज़ात दे दिए गए, साथ ही पेंशन मिलनी भी शुरू हो गई. इस तरह 81 वर्ष की जयलक्षम्मा ने भ्रष्टाचार के खिलाफ एक लड़ाई महज़ 15 दिन में ही जीत ली.”

“रूची मनुज फोणगे, पुणे के साम्बायसिस कॉलेज में पढ़ाती हैं. 1997 में उन्हें यहां अस्थाई रूप से सेवा में रखा गया था, लेकिन 2000 में उनकी सेवा स्थाई कर दी गई तथा कॉलेज में तथा कॉलेज में उन्हें बतौर प्राध्यापक सेवा में लिए जाने का नियुक्ति पत्र भी दे दिया गया. साथ ही उनका वेतन बढ़ने की सूचना भी उन्हें दी गई. लेकिन अगले महीने उन्हें बढ़ी हुई राशि नहीं मिली. रूची ने इस सिलसिले में कई दफ्तरो के चक्कर काटे. इसकी शिकायत शिक्षा निदेशालय से की, लेकिन इसका कोई असर नहीं हुआ. बार-बार लिखित अनुरोध करने के बाद हार कर उसे सूचना के अधिकार का प्रयोग किया और महज़ 29 दिनों में उनका 4 साल का बकाया वेतन 3 लाख रूपये चैक के रूप में मिल गया.”

इस तरह भारतीय लोकतंत्र के इतिहास में सूचना का अधिकार न सिर्फ भ्रष्टाचार पर एक तमाचा है, बल्कि व्यवस्था को दुरूस्त करने के नाम पर राजनीतिक रोटी सेंकने वालों के लिए एक सबक भी है. इस अधिकार के द्वारा न सिर्फ मानवाधिकार के उल्लंघन के मामलों एवं किसी जांच प्रक्रिया के पूरे हो जाने पर उसके बारे में उसके बारे में सूचना प्राप्त की जा सकती है, बल्कि ग्राम प्रधान, क्षेत्र पंचायत , ज़िला पंचायत, नगर पंचायत, विधायक, सांसद, विधान परिषद सदस्य इत्यादि के कार्यों, निधियों एवं आय-व्यय के साथ-साथ महिलाओं के लिए चल रहे विकास कार्यों व योजनाओं का भी ब्यौरा लिया जा सकता है, जिससे महिलाओं की सामाजिक-आर्थिक मज़बूती का मार्ग प्रशस्त होगा.

अगर इस अधिकार के इतिहास पर नज़र डाली जाए इसे लागू करने में सबसे अधिक भागीदारी महिलाओं की ही है. इसके लिए महिलाओं ने ही सैकड़ों रातें पथरीली सड़कों पर गुज़ारी हैं. पुलिस के डंडे खाए तथा जेल भी गई हैं. नेताओं, अफसरों और यहां तक कि अपराधियों ने उन्हें निशाना भी बनाया. कई महिलाओं पर जानलेवा हमले भी हुए.

इस प्रकार इसमें महिलाओं का अमूल्य व अद्वितीय योगदान रहा है. यही कानून महिलाओं को पूरी तरह सुरक्षा देने में सक्षम हो सकता है. सूचना के अधिकार के माध्यम से महिला सशक्तिकरण अभियान को और सशक्त बनाया जा सकता है. क्योंकि पारिवारिक जीवन से लेकर राष्ट्रीय संदर्भ में महिलाएं इस अधिकार का प्रयोग कर बहुत कुछ प्राप्त कर सकती हैं तथा अपनी ज़िन्दगी को एक नई दिशा दे सकती हैं, जिनसे उनकी दशा में सुधार की कल्पना की सकती है.

Had I been writing this piece  few days back, my topic would have been a little different. I would have written something on the lines of what an irony it is to celebrate the International Women’s Day in a country where a majority of women do not have access to education and live a life that is majorly governed by the norms of the society and how it is still a long way before we can celebrate the spirit of womanhood in its true sense; but only if I was writing that particular day.

Events in the past few days have forced me to take a re-look at the world around me, to understand that it is not about education, spreading awareness, and equal rights for women, guaranteeing them the dignity and the respect that they deserve. No… in a society where a girl amidst the crowd is shot dead in broad daylight by her stalker, where every day a girl is being raped in some part of the country and where some couples or the other are being killed in the name of ‘honour’, expecting a woman to get an equal footing is like asking a toddler to win a marathon.

It is not about the dignity and empowerment. For the women living in the capital, it is about their basic survival. It is about taking a bus ride without being pushed around and touched everywhere. It is about working late at night without getting worried about how to get back home. It is about walking on the streets without getting to hear even a single derogatory remark about her. It is about being able to sleep at night without worrying about the same challenges to be faced the next day.

On the International Women’s Day, the virtual world was rife with messages acknowledging women as the backbone of the society.  Newspapers talked about great women achievers. TV programs paid tribute to the Naari Shakti (women empowerment). I am not undermining any of these efforts, but it is hard not to be left bemused seeing these superficial attempts. I am sorry to be a skeptic, but I am sure that the struggle will continue post March 8 as well.  Eve teasing would still be as rampant as it  was before, incidents of rape will continue to be a major part of the news and honour killing would continue to remain an accepted way of taking care of the “strayed” daughter.

In the crime capital of the country, the International Women’s Day proves to be the best opportunity for us to pause for a minute and retrospect.

Can we imagine a world without women? There would be no tears of joys, no dance in the rain, no hues of colour, no silly questions, no dumb answers, no unconditional love, no motherhood and definitely no to massage the vain male ego. If for you, the world seems a better place without women, go ahead…. With your deeds, question the existence of fair sex…. But if you want to see the world through the rainbow prism, do not wait for a Women’s Day to express your gratitude. Do it now. Give women the freedom to walk alone on the street, the courage to work late at night, the strength to be their own boss and the love to be who they are.

New Delhi: Seventy-year-old Karibasamma, first euthanasia petitioner in Karnataka seeking euthanasia, sees hope in yesterday’s Supreme Court’s verdict, allowing what has come to be termed “passive euthanasia,” the withdrawal of life support to patients in a permanently vegetative state (PVS).

However, the verdict rejected outright “active euthanasia” or ending life through the administration of lethal substances and turned down the plea to allow Aruna Shanbaug, who has been in a vegetative state for 37 years, to die.

Suffering from an acutely agonising slipped disc condition for many years, Karibasamma, who worked in various schools in the city for 33 years, wants a quick and painful death, which she thinks is her due. Diabetes has added frustration with life.

The former teacher with no family members caring for her, Karibasamma has been living in an old age home in Davanagere. Frustrated and suffering acute pain, Karibasamma filed a plea seeking mercy killing in the high court.

Karibasamma’s mercy killing case will come up for hearing on March 11 in the Karnataka High Court.

She told BeyondHeadlines that she felt hopeful after learning of the verdict in the Supreme Court in the case related to Aruna Shanbaug. She added that she did not need her family’s consent to end her life.

Seated in her little spartan room at Ananda Dhama, a home for senior citizens, Karibasamma is vocal about right to mercy death. “If I seek death because I cannot bear the pain, such death should not be considered suicide, but a dignified end,” she says.

“The doctors have no answer to my problem. There is no guarantee that surgery make me better. So there is only one way left,” the former teacher says. “I suffer the pain, not my family,” she said, hoping that the panel of doctors to be constituted would support her.

Advocate Pramila Nesargi, who has been arguing Karibasamma’s case, said, “I will bring to the notice of the judge the orders of the Supreme Court and seek the constitution of a panel of doctors.” Nesargi said that the panel would serve as a permanent committee and the first case it would look into would be Karibasamma’s.

In the last hearing of this case in September 2010, the high court directed the National Institute of Mental Health and Neuro Sciences (Nimhans) to give free treatment to Karibasamma for four weeks and submit a report. The Nimhans report suggested that Karibasamma undergo an operation. “In the wake of the Supreme Court’s verdict, those reports will hold no value,” Nesargi said.

Nilakshi Sharma (student): We should ask for the reason of declining sex ratio of girls over boys, reasons for the atrocities against women and reasons for their sexual harassment. It is high time for women to wake up and fight against this discrimination. International Women’s Day (IWD), originally called International Working Women’s Day, is celebrated on March 8 every year. It is a major day of global celebration for women. In different regions, the focus of the celebrations ranges from general celebration of respect, appreciation and love towards women to a celebration for women’s economic, political and social achievements. This day is also called as anti-sexiest day, which no discrimination against female. So after knowing the real meaning of Women’s Day, we should celebrate this day to spread the awareness against this discrimination, which the women have to face at home, in educational institutes or in society in general.

Priyanka Kapil (student): The most beautiful creature God made on the earth is female who are filled with lots of emotions, feelings and courage and the who can give birth to child. International Women’s Day is meant, according to me, to encourage women, be they home maker or professional.

Chaitanya Janker (student): Why is there an International Women’s Day? Why not International Men’s Day?  Because we know that our society is male dominated, and many people do not even know that something like International Women’s Day exists. We keep on blaming men that they do not treat women equal to them. However, in reality, women themselves are not aware of their rights. We are taught that men and women are equal but in practice, it is not witnessed. If women want themselves to be treated equally, we need to rise and speak up for our rights.
