जिस तरह किसी को भी यह उम्मीद नहीं करनी चाहिए कि मनमोहन सिंह के प्रधानमंत्री रहते भ्रष्टाचार पर लगाम लग सकेगी, उसी तरह यह भी नहीं सोचा जाना चाहिए कि श्रीनिवासन के बीसीसीआइ प्रमुख रहते क्रिकेट बोर्ड पारदर्शी और आइपीएल साफ-सुथरा हो सकेगा.

नैतिकता को ताक पर रखने के मामले में मनमोहन और श्रीनिवासन में अद्भुत समानता देखी जा सकती है. एक अपनी निष्क्रियता से अनैतिकता को प्रश्रय दे रहा है और दूसरा अपनी सक्रियता से… हालांकि यह साफ हो चुका है कि अपने भ्रष्ट मंत्रियों को क्लीन चिट देने वाले मनमोहन सिंह ने कानून मंत्री और अपने एक संयुक्त सचिव के ज़रिये कोयला घोटाले की जांच रपट बदलवाई. लेकिन कोई भी कांग्रेसी उनके खिलाफ मुंह खोलने को तैयार नहीं.

ऐसी ही स्थिति श्रीनिवासन की भी है. वह हर तरह की मनमानी कर रहे हैं. लेकिन कोई भी, यहां तक कि दिग्गज पूर्व क्रिकेटर भी उनके खिलाफ मुंह खोलने में लजा रहे हैं.

यह साफ है कि वह आइपीएल टीमों के मालिकों-संचालकों पर कोई जिम्मेदारी डालने के लिए तैयार नहीं. यह बहुत आसानी से समझा जा सकता है कि बीसीसीआइ ऐसा क्यों नहीं करना चाहती?

यदि बीसीसीआइ आइपीएल टीमों के मालिकों को जवाबदेह बनाएगी तो खुद उसके प्रमुख श्रीनिवासन को भी जवाबदेही लेनी होगी, क्योंकि वह चेन्नई सुपर किंग्स के भी मालिक हैं.

समस्या केवल इतनी भर ही नहीं है. यह वही सज्जन हैं जिन पर चेन्नई सुपरकिंग्स को लाभ दिलाने के लिए खिलाड़ियों की नीलामी के नियमों में हेरफेर करने के आरोप हैं. इन्होंने चेन्नई सुपर किंग्स और भारतीय क्रिकेट टीम के कप्तान एमएस धौनी को अपनी एक कंपनी का निदेशक भी बना दिया है. क्रिकेट का थोड़ा-बहुत भी जानकारी रखने वाले यह जानते होंगे कि टीम के चयन में कप्तान की भी भूमिका होती है.

क्या यह अजीब नहीं कि टीम के चयन में वह खिलाड़ी भी भागीदार बने जो उस आइपीएल टीम का कप्तान है, जिसका मालिक बीसीसीआइ प्रमुख भी है?

यह सबको पता है कि सट्टेबाजी कालेधन के कारोबार का ही एक रूप है. लेकिन इसी के साथ यह जानने की भी ज़रूरत है कि आइपीएल टीमों के कई संचालकों पर विदेशी मुद्रा संबंधी नियमों-फेमा-के उल्लंघन के आरोप हैं. शायद सबको याद आ रहा होगा कि अभी हाल में प्रवर्तन निदेशालय के अफसरों ने प्रिटी जिंटा से आठ घंटे तक पूछताछ की.

विभिन्न नियम-कानूनों के उल्लंघन को लेकर ऐसे ही जुर्माने बीसीसीआइ पर भी लगाए जा चुके हैं. आयकर विभाग ने बीसीसीआइ पर 1300 करोड़ रुपये का जुर्माना लगा रखा है तो सर्विस टैक्स डिपार्टमेंट ने 200 करोड़ का…

प्रवर्तन निदेशालय भी फेमा उल्लंघन के सिलसिले में बीसीसीआइ को एक दर्जन नोटिस भेजने के साथ 1500 करोड़ रुपये का जुर्माना लगा चुका है. इस सबके अलावा प्रतिस्प‌र्द्धी आयोग ने भी इस संस्था पर 52 करोड़ रुपये का जुर्माना ठोक रखा है.

A new book on India’s most famous revolutionary who was hanged by the British on March 23, 1931, claims to have unearthed “hidden facts” showing that Bhagat Singh was not executed by hanging. Chaman Ahuja examines the facts revealed in the book.

In Punjab, the spirit of Bhagat Singh is rising again: preparations have started to organise big events to commemorate in a befitting manner the anniversary of his martyrdom. Besides a series of huge melas, rallies and processions, explosion of theatrical bombardment, a spurt of books and treatises and a plethora of political rhetoric, one may expect the occasion to open a Pandora’s box of controversies, old and new. In fact, a Chandigarh publisher, Unistar, blazed the trail by releasing a book in London (on October 28). For all one knows, its hitting the bookstands might prove the stirring of a hornet’s nest. Titled Some Hidden Facts: Martyrdom of Shaheed Bhagat Singh, it carries the subtitle “Secrets unfurled by an Intelligence Bureau Agent of British-India” (sic).

The real focus of the book is on the ‘hidden facts’ pertaining to the execution of Bhagat Singh. Indeed, the book is an attempt to provide new answers to the innumerable unresolved puzzles — e.g., why the unprecedented hanging of the three martyrs at night; why the dead bodies were not handed over to the relatives but cremated post-haste by the administration without the mandatory postmortem; above all, what was the place and nature of the ‘cremation’?

The way the ‘hidden facts’ have come to light is itself a story that is as questionable as it is interesting. The chief source of the startling information is a man who was a British toady — in fact, a most trusted secret agent of the British government. This man called Dalip Singh Allahabadi had worked as a gardener at Anand Bhawan, Allahabad, and had later acquired the dubious distinction of slapping Jawaharlal Nehru when the latter was leading a demonstration against the Simon Commission.

Kulwant Singh Kooner, the co-author of the present book, is the adopted godson of Allahabadi; he lives in Sinfin, Derby (UK). Allahabadi died in 1986 and the two never met again. Meanwhile, the godson had worked out a book based on the notes taken by him but, those being the days of the Emergency, his real father would not let him publish it; in fact, the father pretended that a publisher friend of his was interested in seeing it and he got the manuscript from Kulwant and destroyed it.

Only after the death of his father, in 1992, Kulwant started the process of working again on such material as his memory afforded; he wanted a movie to be based on Allahabadi’s version of the story, but no one took him seriously. And then he met the co-author, G S Sindhra, a homoeopathic doctor, who put in a lot of additional information into Allahabadi’s narrative through research in the British Library, London.

According to Allahabadi — as recalled by Kulwant and presented by Sindhra — the ‘execution’ of Bhagat Singh, Rajguru and Sukhdev marked the execution of a conspiracy code-named “Operation Trojan Horse”, which, in effect, facilitated the pacification of the British officers in general and the prospective in-laws of the late J P Saunders in particular. Accordingly, Bhagat Singh and his associates did go through the formality of ‘hanging’ but only to the extent of breaking their necks; semi-conscious, they were taken to the Lahore Cantonment where the ‘Death Squad’, comprising Saunder’s family, shot them to quench their thirst for revenge.

Since doing all this during day time could have invited a violent reaction from the people, the ‘execution’ was performed at night; for the same reason, the bullet-ridden bodies were neither sent for postmortem nor handed over to the relatives. Instead, most surreptitiously, these were taken in a lorry to a pre-fixed isolated place on a kutcha-road (6 miles away from Lahore, on the right bank of the Beas where it meets the Sutlej) and burnt to ashes. And, to put the people on the wrong track, some flesh and bones were half burnt and buried on the western bank of the Sutlej, near Hussainiwala. Two Indian agents were sent to Lahore to pose as volunteers and tell the Congress people that they had seen at Ganda Singh Wala a big burning pyre from a distance.

Believing the story, some people (including Bhagat’s sister Bibi Amar Kaur) reached the ‘hot’ spot, dug up the flesh and half-burnt bones (plus one big broken but uncharred bone which they surmised must have been the arm of Bhagat Singh, the tallest of the three) that lay buried there, and took these back to Lahore where the half-burnt stuff was ‘properly’ cremated on the bank of the Ravi in the midst of sloganeering crowds, all in tears.

This was precisely what the ‘Operation Trojan Horse’ meant to achieve — the British way of denying the martyrs the honour of a glorious farewell by the people.

The British Authority of India was frustrated with the rising popularity of Bhagat Singh and his ways of exploiting the Government machinery — the courts and Press Newspapers for propagating his ideology. And when on 8th March 1931, Bhagat Singh gave his consent to Bejoy Kumar Sinha to file a mercy petition to the crown on his behalf after a prolong discussion between two friends, the same racial group of some English officers felt that their ambitions could not be fulfilled. So they made a secret plan according to which they send a team of some officers to Delhi and put up the pressure on Lord Irwin and thus getting his silent consent to carry on their plan named “Trojan Horse”. So, on 23rd March, 1931, the “Trojan Horse” plan was fully implemented and after a fake drama of execution the three young men were brought unconscious to a secret place in the Lahore Cantonment where they were shot dead by “the death squad”.

To conceal the whole episode, the authorities had made arrangement for cremation at some secret place on the right bank of the Beas and the Sutlej convergence. On the other hand to divert the public attention, the authorities had made arrangement for another pyre at Hussainiwala.

They were also afraid of postmortem which would reveal the presence of bullets in the dead bodies and the same was the case with the ashes. By doing so, the Englishmen had fulfilled two jobs. One, to pacify the anger of the relatives of Saunders and on other hand they hoped to befool Indians who would pay tributes at the wrong place and would worship the wrong bodies remains.

After some days he (Dalip Allahabadi) got a chance to go through the secret reports of Lahore agent in which it was revealed that on Monday 23rd, three convicted were hanged in Lahore jail at 7.15 p.m. but they were not allowed to die. They fell unconscious after a few seconds of hanging and the unconscious bodies were removed to Lahore Cantonment on a big lorry which was full of wood.

One report also revealed that the leader among the convicted (Bhagat Singh) gained some consciousness after some time. Then the P.A. to the Governor of Punjab, the father-in-law of Saunders, was allowed to shoot at the convicted. He fired bullets on the head and chest of Bhagat Singh and others.

Then the dead bodies were taken to the selected site on the right bank of the Beas-Sutlej river, where the last rites were performed, according to the religious faith of the convicted. The reports also mentioned about the happiness and satisfaction of the British community in Lahore, on the work done by the death squad.

Mr V.N. Smith Superintendent of Police (political) Criminal Investigation Department, Punjab, wrote in his memoirs on “The Saunders Murder Case” being preserved in a microfilm at the British Library London, — “Normally execution took place at 8 am, but it was decided to act at once before the public could become aware of what had happened” — He further wrote that “at about 7 pm shouts of Inquilab Zindabad were heard from inside the jail. This was correctly, interpreted as a signal that the final curtain was about to drop”.

At 7.15 p.m. all the three youngmen were hanged, but, as earlier described, their hanged bodies were removed before their souls departed. All the three were unconscious with broken neck. The man who performed the duty of hangmen was arrested immediately and, according to Dalip Singh’s information, was slain in the room where the dead bodies were usually kept for identification after the execution. New Delhi:  In a latest development , the contentious Biotechnology Regulatory Authority of India (BRAI) Bill which was tabled in the budget session of the parliament by the Science &Technology Minister, Jaipal Reddy has been sent to the Standing Committee of Science and Technology, Environment and Forests for reviewing and reccomendations. The introduction of the bill saw  strong opposition from MPs from more than ten political parties and a host of civil society organisations and individuals including National Advisory Council members like Aruna Roy.

BRAI Bill, though listed for introduction in 2011, had been in a limbo for the last 3 years owing to concerns both inside and outside the Parliament about it becoming a single window clearance mechanism which will lower the bar for open releases of Genetically Modified Organisms into the environment. (ref-our legal critique) There is a growing scientific evidence on the negative impacts of GMOs including GM crops on human health, environment and farm livelihoods.

Due to the controversial nature of the Bill and its flawed mandate, it was demanded by several Members of Parliament that the Bill be referred to a Joint Committee of the Houses so that a comprehensive debate on it could occur.

The Parliamentary Standing Committee on Agriculture, in their report on GM crops last year, had strongly recommended to the government to bring a regulatory system with the primary mandate to  safeguard Biosafety from negative impacts of GM crops instead of  such proposals like BRAI.

Greenpeace India urges the Members of the Parliamentary standing committee on Science and Technology and Environment to uphold the interests of our citizens and recommend the  withdrawal of the BRAI Bill, 2013. What is needed is a Biosafety Protection legislation to safeguard the health of our citizens, our biodiversity and farm livelihoods against risky technologies like GM crops. This is also inline with India’s commitment to International agreements like the Cartagena protocol on Biosafety.

If we accept the official explanation for the death on 18 May of Khalid Mujahid, an under-trial prisoner in Uttar Pradesh accused of terrorism, then India may have just lost a superman. More likely, the police have made up facts and may soon be exposed.

According to the official explanation, Mujahid, 32, was taken ill at 3.40 pm in the eastern district of Barabanki and admitted to a government hospital where he was pronounced dead. This claim was made by none other than the district magistrate of Barabanki, S Minisati, when she visited the hospital. But Mujahid’s lawyer says he had minutes earlier been in another city 65 km away to attend the hearing in one of the terror cases in which he is an accused. “Mujahid left that courtroom at 3.30 pm,” says Randhir Singh Suman, his lawyer. “How did he cover 65 km in 10 minutes?”

Good question. But then, Mujahid’s tragic story is a litany of such irreconcilable facts right from the day he was arrested by the anti-terrorism Special Task Force of the Uttar Pradesh Police in December 2007. Indeed, the police have been thoroughly exposed as lying about him right from the beginning. Yet, it confounds common sense and offends judicial propriety that successive judges not only did not throw out the case against Mujahid as wholly spurious but also refused to grant him bail that he deserved.

Worse, a trial judge ignored his repeated pleas, including written, that the policemen that ferried him between the prison and the court had explicitly threatened to kill him in an “encounter”, a euphemism for extrajudicial killings by the police. Two months ago, a second lawyer who represented Mujahid in another terror case being prosecuted in Lucknow, Mohammad Shoib, told the state’s jail minister that the several Muslim youths, including Mujahid, being tried for terrorism faced threats to their lives. Shoib was also among the last to see Mujahid alive. “We were together in the court until 3.20 pm,” he says. “Ten minutes later, I saw the police van carrying him leave the court premises.”

And now Mujahid is dead. Here is how the state, its police and the judiciary combined to first frame him and then deny him justice.

On 22 December 2007 police announced the arrest of two “terrorists” from a location 20 km east of Lucknow, the capital of Uttar Pradesh. They were apprehended, police said, from a railway station in the town of Barabanki that is a satellite of the capital. One of the two arrested men was Mujahid, a madrassa teacher in Jaunpur district, 250 km east of Lucknow. The other was Tariq Kasmi, a practitioner of the Unani medicine system in the district of Azamgarh, which is adjacent to Jaunpur.

The police claimed that Mujahid and Kasmi were responsible for simultaneous bombings in the district courts of Lucknow and Faizabad, which is 120 km east of the capital, on 22 November 2007. They said the two men had been arrested with explosives. Subsequently, the two were implicated in three different cases: one each in Lucknow and Faizabad for the bombings, and one in Barabanki for carrying explosives. They were charged with sedition and waging war against the state, both colonial era constructs, as also under the Unlawful Activities Prevention Act and the Explosives Act.

Instantly, Mujahid’s family members and well-wishers as well as human rights activists jumped in and demolished the police story. They claimed Mujahid was arrested in broad daylight from a crowded market six days previously, on 16 December 2007. His arrest had sparked protests in his town, Madiyahu, in Jaunpur district. Newspapers had reported both. Local police, civil officials and even the courts were given representations against his arrest. Yet, a judicial magistrate bought the police version that it arrested Mujahid and Kasmi from Barabanki railway station on 22 December 2007.

Could this be dismissed as partisan bickering? If yes, then consider this. In response to a plea filed under the Right to Information (RTI) Act, the police station in Mujahid’s township, too, acknowledged that he had been arrested from the market near his house on 16 December 2007. This evidence directly contradicted what the police had told the Barabanki magistrate, before whom the two men had been presented and who had remanded them to a police custody. Mujahid quickly sought to file the RTI reply with various trial courts in Barabanki, Lucknow and Faizabad and press for justice.

But the courts told him that they can’t accept the RTI document until the prosecution had finished its arguments. That was in 2009. It is 2013 now and the prosecution hasn’t yet finished its arguments. So the defence lawyers decided to try their luck with the high court to at least get him bail. They believed that the discordance in the two versions of police should make it an open-and-shut case in their favour. But the High Court said he was accused of a “heinous crime” and could not be bailed.

In fact, eyebrows are also raised at the role of the then Chief Judicial Magistrate (CJM) of Barabanki, Anupama Gopal Nigam, who first remanded Mujahid (and Kasmi) in police custody. As per the procedure, the police needed to file an application before the CJM informing of the arrests of the two men and then asking the magistrate to come down to the prison to hear Mujahid and Kasmi’s remand plea because they did not want to bring them to the court for security reasons. “But no such document exists in the court records,” Mujahid’s lawyer, Suman, told TEHELKA from Barabanki. “Did the CJM go to the jail on her own?”

There is more. Suman cross-examined a police officer named Dayaram Saroj when the prosecution called him to depose. As the investigating officer in the case, Saroj should have made that formal request before the CJM. On being cross-examined, Saroj claimed that he himself had handed such an application to the CJM when she visited the prison after the arrests. But in response to an RTI application, prison authorities told Mujahid’s family that Saroj did not visit the prison that day. “This is a serious lapse,” Suman said.

On 19 May, Mujahid’s uncle, Zahir Alam Falahi, filed a First Information Report (FIR) with the Barabanki police alleging that Mujahid had been murdered as a result of a conspiracy. The FIR directly named a total of 42 officers, including a former director-general of police, the highest-ranking police officer in the state, as responsible for it. The question is: why would these police officers want to eliminate Mujahid?

The answer ironically lies in the first real spark of hope for Mujahid. After sustained pressure from human rights groups and various organisations of the Muslims, UP Chief Minister Akhilesh Yadav’s government moved the local court in Barabanki on 3 May 2013 seeking to withdraw its charges against Mujahid and Kasmi. A week later, Additional Sessions Judge Kalpana Mishra of Barabanki rejected the state’s request on a plea from some local lawyers. “These lawyers are from the RSS,” says Suman, referring to the Hindu supremacist Rashtriya Swayamsevak Sangh. “She heard them in her chamber and passed the order without the defence being present.”

But the battle may already be tilting in favour of the accused. For three years, a rights platform named Rihaee Manch has vigorously exposed police falsehoods in cases of terrorism in UP and campaigned to seek the release of the accused. The issue picked up steam last year when leading political figures such as Prakash Karat of the CPM, AB Bardhan of the CPI, Bihar politicians Lalu Prasad Yadav and Ram Vilas Paswan, and Congress Rajya Sabha MP Mani Shankar Aiyar came together and demanded an end to what they called the politics of terror against Muslims.

In 2008, then UP Chief Minister Mayawati had asked retired district judge RD Nimesh to probe the allegation that the police had illegally arrested the two men. He finally submitted his report last August. Although Chief Minister Yadav’s government has stonewalled the demands to release that report, it is widely believed that the commission has damned the police for arresting Mujahid and Kasmi and ruled their arrest as illegal.

“The police officers involved in Mujahid’s illegal arrest are obviously worried,” Shahnawaz Hussain, an activist with Rihaee Manch, told TEHELKA over phone from Jaunpur where he had gone to attend Mujahid’s funeral. “Had Mujahid lived, he would have been a prime witness in the case against them and they couldn’t afford that.”

The defence lawyers and rights activists are now worried for the safety of the remaining accused, who include Kasmi and two Kashmiri men, Sajjadur Rahman and Akhtar who were arrested from Jammu and Kashmir on 22 December 2007 and handed over to UP Police a week later. Strangely, the Jammu and Kashmir Police dropped the original charges on which it had arrested the two men before turning them over to UP Police.

The next hearing in the original case in Barabanki will be held on 31 May 2013. The defence lawyers say they would move the court to ensure that the lives of the other accused are not endangered. “Ironically though, greater security would mean a greater threat to their lives as it is the police who want them eliminated,” Suman said. On 16 May 2013, human rights defender and maternal health activist Ms Madhuri Ramakrishnasway was arrested outside the court in Barwani in Madhya Pradesh, in a case brought against her after a protest. Madhuri Ramakrishnasway is a leader of Jagrit Adivasi Dalit Sangathan (JADS), a tribal and Dalit Rights Collective which has been working for fourteen years in Madhya Pradesh. Advocacy organisations often come together under the banner of JADS to hold peaceful protests in order to raise awareness of the extremelypoor health care for women in pregnancy and labour. Sit-in protests are now taking place outside police stations in the district in solidarity with the human rights defender.

It is reported that Madhuri Ramakrishnasway was arrested in a case brought against her because she had protested against the forcing of Ms Baniya Bai to give birth outside Menimata PHC hospital in 2008. The human rights defender had received notice to appear in the Judicial First Class Magistrate Court presided over by Mr D.P. Singh Sewach on the above date and was subsequently arrested there. Madhuri Ramakrishnasway will be remanded in custody until 30 May 2013 in Khargone women’s jail. The human rights defender is reportedly being held on charges of deterring a public servant from his duty and rioting with a deadly weapon.

On the night of 11 November 2008, Baniya Bai was brought by her father-in-law to Menimata PHC when she went into labour. The next morning, Baniya Bai was asked for 100 Indian rupees and since she could not provide this, was forced to leave the hospital. She then gave birth in public view on the road outside the hospital. The human rights defender witnessed this event and took Baniya Bai to another hospital where she received treatment. Madhuri Ramakrishnasway then launched a protest against the incident, and the compounder of Menimata PHC, Mr Vijay Kumar, filed a complaint against her.

Front Line Defenders believes that Madhuri Ramakrishnasway is being held solely on account of her peaceful and legitimate work in defence of human rights, particularly maternal rights, in Madhya Pradesh.

Front Line Defenders urges the authorities in India to:

1. Immediately and unconditionally release Madhuri Ramakrishnasway and drop all charges against her as it is believed they are solely motivated by her peaceful and legitimate work in defence of human rights;

2. Guarantee in all circumstances that all human rights defenders in India are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including judicial harassment.

वर्ष 2000 में पत्नी अलका दास के चेयरमैन रहते अखिलेश दास गुप्ता ने एचडीएफसी बैंक के साथ मर्केंटाइल कोआपरेटिव बैंक के डीमैट खाता संख्या 1201320100000982 से ब्रोकर संचिता शेयर्स प्रा.लि. चैक लखनऊ व सेंचुरी कंसल्टेंट के जरिए 50 करोड़ की इक्विटी अर्थात शेयर खरीदे.

उसके बाद इन शयेरों को भुनाकर करीब 50 करोड़ की रकम अपने पास रख ली, जबकि अखिलेश दास को यह रकम बैंक को देनी चाहिए थी. बैंक के पैसे से शेयर नहीं खरीदे जा सकते. यह आरबीआई के दिशा-निर्देशों में साफतौर पर दिया हुआ है.

यहीं नहीं आरबीआई तक ने अपनी निरीक्षण रिपोर्ट में कहा है कि इंडियन मर्केंटाइल कोआपरेटिव बैंक ने अपने एचडीएफसी बैंक के खाता संख्या 38 से 14.8.2000 को पांच करोड़ व 19.8.2000 को तीन करोड़ रुपए इलाहाबाद बैंक में विराज कंस्ट्रक्शन कंपनी के खाते को दिए. जिसके बाद यह पैसा विराज कंस्ट्रक्शन के मर्केंटाइल बैंक के खाते में स्थानान्तरित हो गया और बाद में अखिलेश दास गुप्ता ने यह भारी पैसा बैंक से निकाल लिया. तब बैंक में चेयरमैन अखिलेश दास की पत्नी अलका दास गुप्ता थी. इस तरह बैंक से अखिलेश दास गुप्ता को कितना पैसा गया, यह गंभीर जांच का विषय है.

इंडियन मर्केंटाइल बैंक के तत्कालीन सीनियर मैनेजर जेके अग्रवाल के बेटों के नाम भी करोड़ों के फर्जी ऋण लेकर बाद में यह पैसा पहले से तैयार फुलपू्रफ प्लानिंग के तहत अखिलेश दास गुप्ता ने हड़प लिया. आरबीआई की रिपोर्ट के अनुसार मर्केंटाइल बैंक की कैंट स्थित ब्रांच से गणपति एसोसिएटस के प्रोपराइटर रजत अग्रवाल (खाता संख्या 382) को व्यापार के लिए 29 नवंबर 2010 को 1 करोड़ 45 लाख का ऋण दिया गया.

अब जरा पूरे खेल से पर्दा हटाया जाए. एक सुनियोजित षडयंत्र के तहत पहले करीब डेढ़ करोड़ का पेमेंट आर्डर 31 दिसंबर 2010 को जारी किया गया. उसके बाद पेमेंट आर्डर को निरस्त कर पूरा पैसा बैंक के मुख्य शाखा को हस्तान्तरित करवा दिया गया. इसके बाद सूत्रों की माने तो यह पैसा अखिलेश दास ने नकद निकलवा लिया. खास बात यह है कि इस ऋण के बदले रजत अग्रवाल ने 1 करोड़ 89 लाख की कृषि भूमि सुरक्षा के तौर पर गिरवी रखी, वह आयी कहां से. यह भी जांच का विषय है.

निरीक्षण रिपोर्ट में साफ लिखा हे कि ऋण लेने वाले के व्यापार की कोई जानकारी नहीं है. वहीं फंड के प्रयोग पर भी अनिश्चितता बताई गयी थी. इसी तरह जेके अग्रवाल के दूसरे बेटे आशू एसोसिएटस के प्रोपराइटर प्रतीक अग्रवाल ने भी किया. कैट ब्रांच के खाता संख्या सीसी 381 के जरिए प्रतीक को पहले 1 करोड़ 40 लाख का ऋण दिया गया. बाद में यह पैसा नोएडा मुख्य शाखा में चला गया. यह पैसा भी अखिलेश हड़प गए. यह गोरखधंधा लाल सिंह (खाता संख्या सीसी 380) के जरिए भी अंजाम दिया गया. जिन्हें करीब 4 करोड़ 17 लाख का ऋण दे दिया गया था. बैंक के नियमों के तहत सीईओ को केवल पांच लाख के ऋण स्वीकृत करने की पावर के बावजूद करोड़ों के ऋणों को अनुमोदन दिया गया. इंडियन मर्केंटाइल बैंक में अखिलेश दास की महालूट की जांच भारत सरकार कराए तो हजारों करोड़ के घोटालों का खुलासा तो होगा ही साथ अखिलेश दास जैसे लुटेरों के असली चेहरे बेनकाब होगे.

मैं खालिद मुजाहिद हूँ… मैं एक बेगुनाह हूँ… मैं एक हिन्दुस्तानी हूँ… मुझे हिमालय की कसम… मुझे गंगा जमना की क़सम, जिसके संगम पर मैंने अपने मदरसे में कुरान पाक याद किया… मैंने अपने मुल्क के किसी भी शहरी को कभी भी अपनी ज़बान से, हाथ से, अपने ख्याल में भी कोई तकलीफ नहीं दी है.

शादी के दो महीने के अन्दर ही मेरे और मेरी बीवी के बीच में जेल के दीवार खड़ी कर दी गयी. लेकिन मैंने दीवार के पीछे उसके रोने के आवाज़ सुनी है. वो मुझसे नाराज़ हो गयी थी. उसने मेरे लिखे ख़त के जवाब देना बंद कर दिये थे. लेकिन मुझे मालूम है कि वो मेरा इंतज़ार कर रही है…

आप लोगों ने संघर्ष करके मेरी रिहाई की कोशिश की… ऐसा लगा कि अब मैं रिहा हो जाऊंगा. मेरे बूढ़े चचा की आँखों के चमक कहती थी कि मैं घर वापस जाऊंगा… मेरा बड़ा भाई भी खुश था… लेकिन उस दिन आखरी बार सुनवाई हुई और मुझे रस्ते में किसी ने बेरहमी से मारा… मैंने मदद को आवाज़ लगाई… मैंने अखिलेश सिंह की सरकार को गुहार लगाई… मैंने हिंदुस्तान के संविधान को पुकारा… किसी ने मेरी नहीं सुनी…

मैं खामोश हो गया… सब लोग कह रहे हैं कि मैं मर गया हूँ… लेकिन मैं मरा नहीं हूँ… मैं अभी भी अदालत के बाहर खड़ा हूँ… अपनी तारीख का इंतज़ार कर रहा हूँ… मैं विधान सभा के बाहर खड़ा हूँ… मैं राष्ट्रपति के दरवाज़े पर खड़ा हूँ… न्याय के लिए….

मेरी बेगुनाही साबित हो जाने तक मैं मरूँगा नहीं… मैं हर हिन्दुस्तानी के ज़मीर को आवाज़ देता रहूँगा… उस वक़्त तक जब तक मेरी बेगुनाही का फैसला लेकर आप मेरी कब्र पर दोबारा फातिहा पढ़ने न आ जाये… वही मेरी बेगुनाही का ख़त मेरी कब्र के पास लगा दीजियेगा… ताकि मुझे भरोसा हो जाय कि मेरी मौत के साथ इस मुल्क में इन्साफ की मौत नहीं हुई है… क्योंकि मैं बेगुनाह हूँ और बेगुनाह कभी मरता नहीं…

दंतेवाड़ा ज़िले के बेंगपाल में शनिवार की सुबह सुरक्षा बल के जवानों ने ग्रामीणों पर कहर ढाया. साथ ही वो पांच ग्रामीणों को भी नक्सलियों की वर्दी पहनाकर अपने साथ ले गए.

ग्रामीणों के मुताबकि 18 मई की सुबह सुरक्षा बल के जवान ग्राम बेंगपाल पहुंचे. गांव ने उंडामी भीमा पिता देवा उंडामी, हुंगा पिता देवा, आयतू पिता नंदा एवं हिरोली दोकापारा निवासी जोगा कड़ती, लेखामी पोदिया, तुमनार निवासी लखमे एवं मोटू पिता देवा को पकड़ कर उनको काली वर्दी पहनाई. उसके बाद उक्त ग्रामीणों में से लखमें एवं मोटू को जवानों ने छोड़ दिया तथा शेष पांचों ग्रामीणों को अपने साथ हेलीकॉप्टर से पुरंगेल की ओर ले गए.

बेंगपाल के ग्रामीणों ने यह भी बताया कि सुरक्षा बल के जवानों ने ग्रामीणों के साथ मारपीट की एवं गांव के 25 घरों से रूपये, जेवरात, मुर्गा-मुर्गी एवं चावल लूट कर ले गए.

इस पूरे मामले पर मानव अधिकार कार्यकर्ता हिमांशु कुमार बताते हैं कि संभवत पुलिस उन पांचों को मार देगी, जैसा वो पहले से करते आई है. और फिर इसे एक मुठभेड़ बता देगी . उसके बाद इनके साहब को तरक्की मिल जायेगी और छत्तीसगढ़ सरकार को दिल्ली से और पैसा मिल जाएगा. रही बात आदिवासियों की तो इन्हें तो कोई भी नहीं बचा सकता अब. आदिवासियों की इस तरह की फर्जी हत्याओं के अनेकों मुकदमे अभी हाई कोर्ट और सुप्रीम कोर्ट में लटके हुए हैं .  सच पूछे तो कोर्ट इन आदिवासियों के लिये नहीं हैं. सरकार इन्हें मार रही है . ये आदिवासी अपनी जान कैसे बचाएं ?

इसी बीच यह भी खबर मिली है कि छत्तीसगढ़ के बीजापुर में फिर से आठ आदिवासियों को पुलिस ने मार डाला है . सभी गाँव वाले थे. पुलिस ने भी इनके माओवादी होने का दावा नहीं किया है.

ये सभी आदिवासी अपनी नई फसल की बुआई से पहले बीज की पूजा कर रहे थे. पिछले साल भी इसी समय बीज की पूजा करते हुए सत्रह निर्दोष आदिवासियों की इसी तरह हत्या कर दी गई थी. तब सरकार ने दावा किया था कि मारे गये लोग दुर्दांत माओवादी थे. लेकिन बाद में साबित हुआ कि वे तो स्कूल में पढ़ने वाले बच्चे और गाँव वाले थे.

मानव अधिकार कार्यकर्ता हिमांशु कुमार बताते हैं कि ‘हमने दंतेवाड़ा में अनेकों जनसंहार देखे हैं. इन में से सभी में आदिवासियों ने कभी पुलिस को किसी भी तरह से नहीं उकसाया. लेकिन पुलिस ने बिना किसी उकसावे के आदिवासियों का सामूहिक संहार किया है. हांलाकि ध्यान से देखा जाय तो इस तरह के जनसंहार से सरकार को फायदा कम और नुकसान  ज़्यादा होता है. हम एक समाज हैं. समाज नियमों से चलता है. नियम समाज ने ही बनाये हैं. अगर सरकार नियम तोडती है तो उस पर से समाज का विश्वास कम हो जाता है. इस हालत में सरकार का विरोध करने वाली ताकतों के प्रति लोगों को अधिक सहानुभूति मिलने लगती है.’

आगे वो बताते हैं कि ‘अब सरकार जनता के बल पर नहीं बल्कि बाज़ार की शक्तियों के पैसों के दम पर चुनाव जीतती हैं. इसलिये सरकार को जनता की नहीं बल्कि खुद को पैसा देने वाले उद्योगपतियों की ज़्यादा परवाह है.  इस हाल में जनता के कल्याण के नाम पर चुनाव जीतने वाली सरकार अपनी ही जनता को मारने लगती है. इसलिये हमें याद रखना चाहिये जब हम आदिवासियों की हत्या करते हैं तो दरअसल हम अपने लोकतन्त्र की हत्या कर रहे होते हैं. इसी के साथ अपनी संस्कृति, धर्म, परम्परा  और सम्मान की भी हत्या कर देते हैं.’

आईपीएल जिस तरह स्पॉट फिक्सिंग से दो-चार हुई, उससे क्रिकेट के साथ-साथ भारतीय क्रिकेट कंट्रोल बोर्ड भी शर्मसार हुआ है. स्पॉट फिक्सिंग में क्रिकेटरों समेत सट्टेबाजों की गिरफ्तारी के बाद भारतीय क्रिकेट कंट्रोल बोर्ड के सारे दावे ध्वस्त हो गए कि आइपीएल हर तरह की गड़बड़ी से मुक्त है.

अब जब गड़बड़ी का पहाड़ सामने आ गया है तब इस तरह की बातें करने का कोई मतलब नहीं कि दोषी खिलाड़ियों के खिलाफ कड़ी कार्रवाई की जाएगी. ऐसा तो उसे न चाहते हुए भी करना होगा. अगर क्रिकेट कंट्रोल बोर्ड अपने दावे के मुताबिक चुस्त-दुरुस्त था तो फिर वह क्रिकेटरों पर निगाह क्यों नहीं रख सका? क्या यह अजीब नहीं कि ये क्रिकेटर इतनी आसानी से सटोरियों से सौदेबाजी कर फिक्सिंग करते रहे और बोर्ड को भनक तक नहीं लगी?

ऐसा लगता है कि क्रिकेटरों के बीच सटोरियों ने अच्छी पकड़ बना ली है. क्योंकि वे रह रहकर अपना गंदा खेल दिखाने में कामयाब हो जाते हैं. उनका काम इसलिए आसान हो गया है, क्योंकि इस खेल में ज़रूरत से ज्यादा पैसा आ गया है और शायद ऐसे खिलाड़ियों की भी कमी नहीं जो रातों-रात करोड़पति हो जाना चाहते हैं.

नि:संदेह ऐसा नहीं है कि लालची क्रिकेटरों पर काबू न पाया जा सके. यह निराशाजनक है कि इसके लिए जैसे क़दम उठाए जाने चाहिए वैसे नहीं उठाए जा रहे. इससे भी निराशाजनक यह है कि भारत में सट्टेबाजी को बढ़ावा मिलता दिख रहा है. सब जानते हैं कि भारत में क्रिकेट मैचों के दौरान सटोरियों की दुकानें सज जाती हैं. लेकिन सट्टेबाजी पर अंकुश के लिए कोई कड़े उपाय नहीं किए जा रहे हैं.

क्या सट्टेबाजों के लिए इससे अनुकूल और कुछ हो सकता है कि भारतीय कानून की किसी भी धारा में मैच फिक्सिंग अपराध नहीं है? चौदह साल पहले हुए मैच फिक्सिंग के मामले में सीबीआई ने पूरा केस यह कहते हुए बंद कर दिया था कि किसी भी कानून के तहत क्रिकेटरो के खिलाफ आरोपपत्र दाखिल नहीं किया जा सकता.

1999 मे दिल्ली पुलिस ने इसी तरह साउथ अफ्रीका टीम के कप्तान हैंसी क्रोनिया के साथ मो.अजरुद्दीन, अजय जडेजा आदि जैसे बड़े खिलाड़ियों के मैच फिक्सिंग में शामिल होने का खुलासा किया था. बाद में इस मामले की जाँच सीबीआई ने इन खिलाड़ियो के खिलाफ आरोपो को सही पाया और उनके खिलाफ पुख्ता सबूत भी जुटाए. लेकिन कानून की किसी भी धारा मे मैच फिक्सिंग को अपराध नहीं ठहराए जाने के कारण सीबीआई किसी भी खिलाड़ी के खिलाफ चार्जशीट दाखिल नहीं कर सकी.

इसी जाँच को आधार मानकर बाद में बीसीसीआई ने ज़रुर कुछ खिलाड़ियो पर प्रतिबंध लगाया. मैच फिक्सिंग की जाँच से जुड़े रहे सीबीआई के एक वरिष्ठ अधिकारी ने कहा कि खिलाड़ियो के खिलाफ चार्जशीट करने के लिए सुप्रीम कोर्ट के पूर्व न्यायधीश जस्टिस एम.के.मुर्खजी और तत्कालीन सोलीसिटर जनरल हरीश साल्वे से कानूनी सलाह भी ली गयी.

ये दोनो न्यायविद भारतीय दंड संहिता (IPC) की धारा 415 417 व 420 जुआ निरोधक कानून के साथ साथ भ्रष्टाचार निरोधक कानून की धाराओ के तहत मैच फिक्सिंग के आरोपियों को चार्जशीट करने पर विस्तार से विचार करने के बाद इस फैसले पर पहुंचे थे कि इनमें से किसी भी कानून के तहत आरोपियो के खिलाफ कोई भी कार्यवाही नहीं की जा सकती.

कोई इस पर भी विचार करने के लिए तैयार नहीं है कि क्या कई अन्य देशों की तरह भारत में भी सट्टेबाजी को कानूनी मान्यता देने की ज़रूरत है?

अगर भारतीय क्रिकेट कंट्रोल बोर्ड और साथ ही उस पर विशेष कृपादृष्टि रखने वाली भारत सरकार चेतती नहीं थोड़ी चीख-पुकार के अलावा ऐसा कुछ भी नहीं होने वाला जिससे सट्टेबाज और लालच के मारे क्रिकेटर इस खेल को और दूषित न कर सकें.

सूत्रों के मुताबिक प्रधानमंत्री कार्यालय ने इंटेलिजेंस ब्यूरो के निदेशक आसिफ इब्राहिम से एक अति गोपनीय पत्र में IPL कमिश्नर राजीव शुक्ला और दिल्ली पुलिस के कमिश्नर नीरज कुमार के रिश्तों को लेकर 4 बिंदुओं पर जानकारी मांगी है. ये जानकारी दिल्ली पुलिस की IPL फिक्सिंग जांच को लेकर है.

खबर सनसनीखेज है और अब ये कहा जा रहा है की खिलाड़ियों के नाम आने के बाद क्रिकेट बोर्ड की एक रसूखदार लाबी ने जांच  को आधे रास्ते ही रोकने के लिए पुलिस पर दबाव डाला. फ़िलहाल मामला 12 तुग़लक लेन तक पहुँच गया है और कांग्रेस के एक बड़े नेता ने राहुल गाँधी को इस घालमेल पर अपडेट किया है और परदे के पीछे की राजनीती बता दी है.

सूत्रों के अनुसार राहुल चाहते है कि क्रिकेट में अगर धांधली है तो जांच निष्पक्ष और तह तक होनी चाहिए. सूत्र यह भी बताते है कि कांग्रेस की एक लाबी अब ये कोशिश कर रही है कि पीएमओ स्पॉट फिक्सिंग की व्यापक जांच दिल्ली पुलिस से लेकर सीबीआई को सौंप दे.

कांग्रेस के कुछ बड़े नेताओं ने हाई कमांड से कहा है कि IPL में देर सवेर ऊँगली सरकार के कुछ मंत्रियों तक पहुंचेगी. इसलिए बेहतर होगा कि समय रहते बढ़ते विवाद को खत्म कर दिया जाये.

चुनाव का वक्त नजदीक है और सरकार एक और कलमाडी बर्दाश्त नहीं कर सकेगी. सच तो ये है कि जिस तरह क्रिकेट फिक्सिंग की जांच अचानक ही बीच में रोकनी पड़ी… इससे दिल्ली पुलिस कमिश्नर नीरज कुमार और IPL कमिश्नर राजीव शुक्ला के पुराने रिश्ते सवालों के घेरे में आ गए.

ज़ाहिर तौर पर शुक्ला के खिलाफ लाबी 10 जनपथ में सक्रिए हो रही है. बहरहाल इंटेलिजेंस ब्यूरो ने पहली रिपोर्ट में पीएमओ को संकेत दिये है कि IPL में व्यापक भ्रष्टाचार है. दूसरी रिपोर्ट में इंटेलिजेंस ब्यूरो की जांच का इन्तेज़ार रहेगा…

उत्तर प्रदेश के रिहाई मंच ने खालिद मुजाहिद की हत्या को सपा सरकार की सरपरस्ती में एसटीएफ अधिकारियों को बचाने के लिए की गई साजिशन राजनितिक हत्या क़रार देते हुए कहा कि इस शहीद मौलाना खालिद मुजाहिद के जनाजे से सपा सरकार की उल्टी गिनती शुरु हो गई है.

रिहाई मंच ने सरकार को चेतावनी देते हुए कहा कि सरकार इस मुगालते में न रहे की कि मौलाना खालिद की हत्या कराकर इस आंदोलन को रोक देगी. 2007 में खालिद-तारिक की रिहाई को लेकर शुरु हुआ बेगुनहों की रिहाई का यह आंदोलन जिसके नीवं में खालिद के चचा ज़हीर आलम फलाही रहे हैं, को हम मंजिल तक पंहुजाएंगे. क्योंकि यह दिन हमारे लिये शोक का नहीं बल्कि संकल्प का दिन है.

मंच ने बाराबंकी में खालिद मुजाहिद के पंचनामे पर सवाल उठाते हुए कहा कि जिस तरह से बाराबंकी प्रशासन ने पंचनामे में समाजवादी पार्टी से जुड़े नेताओं को पंच बनाया और इस तथ्य को परिजनों तथा वहां मौजूद सैकड़ों लोगों  से छिपाया उससे जाहिर हो जाता है कि प्रशासन की नियत वास्तविक तथ्यों को छिपाने का था. रिहाई मंच के नेताओं ने कहा कि खालिद के चचा जहीर आलम फलाही समेत कई लोगों ने खालिद के शव का निरिक्षण किया, जिसके मुताबिक खालिद के कान और नाक के आस-पास खून के धब्बे थे, उनके गर्दन की हड्डी पर किसी भारी चीज से मारे जाने का जख्म के निशान के चलते वहां काला धब्बा और सूजन थी, बायें हाथ की कोहनी के ऊपर काला निशान और चेहरा शरीर के बाकी हिस्से के मुकाबले स्याह होना तथा सूजा हुआ था.

इसके बावजूद पोस्ट मार्टम के पहले ही बाराबंकी के पुलिस अधिक्षक सैयद वसीम अहमद का यह कहना कि खालिद की मौत स्वाभाविक कारणों से हुई है, प्रशासन को कटघरे में खड़ा करता है कि पुलिस का पूरा जोर मौलाना की हत्या के वास्तविक तथ्यों को छिपाना था.

रिहाई मंच के अध्यक्ष और खालिद के अधिवक्ता मोहम्मद शुएब ने कहा कि फैजाबाद जेल में 3 साढे़ तीन बजे वो साथ थे और खालिद पूरी तरह स्वस्थ था और उसने अपने परिवार वालों को सलाम भी भेजा था. सबसे अहम बात कि फैजाबाद में वह कुर्ते-पैजामे में था जबकि सुबह जब पोस्टमार्टम के समय शव को परिजनों को दिखाया गया तो वो टी शर्ट और लोवर में था, जिसे मौलाना खालिद कभी पहनते ही नहीं थे. और उनके साथ दिखाए गए सामानों में भी कुर्ता-पैजामा नहीं था, जिससे साफ हो जाता है कि स्कोर्ट ने जब हत्या की तो मौलाना खालिद के नाक-कान से निकला खून जो उनके कपड़े पर भी गिर गया, जिसे छुपाने के लिए उनके कुर्ते-पैजामें को छुपा दिया गया और मौलाना खालिद को टी शर्ट-लोवर पहना दिया गया.

इन सब बातों से स्पष्ट हो जाता है कि खालिद की मौत स्वाभाविक नहीं बल्कि सपा सरकार के सरंक्षण में सुनियोजित आपराधिक षडयंत्र के तहत की गई जघन्य हत्या है.

रिहाई मंच को शक है कि जिस तरह से पंचनामे से ही तथ्यों को छिपाने की कोशिश शुरु हो गई उससे प्रशासन की नियत पर संदेह बढ़ जाता है कि वह पोस्ट-मार्टम रिपोर्ट में भी इन तथ्यों को छिपाते हुए इसे स्वाभाविक मौत करार दे.
बाराबंकी में मौजूद रिहाई मंच के अध्यक्ष मोहम्मद शुएब और प्रवक्ता शाहनवाज आलम और राजीव यादव ने कहा कि वहां मौजूद लोगों द्वारा जिलाधिकारी बाराबंकी से मांग के बावजूद कि वहां मुख्यमंत्री आकर परिजनों से मिलें और
उनकी बात सुने. लेकिन संवेदनहीन अखिलेश को यह बात मंजूर नहीं हुई.

मंच ने कहा कि खालिद के चचा ज़हीर आलम फलाही द्वारा डीजीपी विक्रम सिंह, एडीजी कानून व्यवस्था बृजलाल, मनोज कुमार झा, चिरंजीवनाथ सिन्हा, एस आनंद और आईबी के खिलाफ नामजद एफआईआर दर्ज कराने के बावजूद न अब तक इन अधिकारियों को और न ही इस हत्या को अजांम देने वाले पुलिस स्कोर्ट को अब तक गिरफ्तार किया गया और न ही इनको निलंबित किया गया.

मडि़याहू में मौजूद रिहाई मंच आज़मगढ़ के संयोजक मसीहुदीन संजरी, तारिक शफीक, शाहनवाज आलम, राजीव यादव, सालिम दाउदी, गुलाम अम्बिया, सादिक खान, शौकत अली, वर्धा महाराष्ट्र से आए लक्षमण प्रसाद, अब्दुल्ला एडवोकेट, दिल्ली से आए एपीसीआर के राष्ट्रीय संयोजक अखलाक अहमद ने बताया कि जिस तरह आज खालिद के जनाजे में बीसीयों हजार से ज्यादा लोगों ने शिरकत की और सरकार के खिलाफ प्रदर्शन हुए उसने यह साफ कर दिया है कि सपा सरकार ने खालिद की हत्या करवाकर अपनी कब्र खोद ली है. जिसका मुहतोड़ जवाब देने के लिए जनता तैयार है.

रिहाई मंच ने मांग की है कि:-

1- खालिद मुजाहिद के चचा ज़हीर आलम फलाही द्वारा दर्ज कराई गई एफआईआर में नामित डीजीपी विक्रम सिंह, एडीजी कानून व्यवस्था बृजलाल, मनोज कुमार झा, चिरंजीवनाथ सिन्हा, एस आनंद पुलिस अधिकारीयों और खालिद को ले जा रहे पुलिस स्कोर्ट को तत्काल प्रभाव से टर्मिनेट किया जाय, तथा आईबी समेत सभी दोषियों को तत्काल गिरफ्तार करके कानूनी कार्यवाई शुरु की जाए.

2- सपा सरकार अपने चुनावी वादे के मुताबिक आतंकवाद के नाम पर कैद बेगुनाह नौजवानों को तत्काल रिहा करे. क्योंकि मौलाना खालिद की हत्या ने साफ कर दिया है कि जो सरकार मौलाना की हत्या करवा रही है वो किस आधार पर अन्य को सुरक्षा दे सकती है.

3- शहीद मौलाना खालिद मुजाहिद और हकीम तारिक कासमी को निर्दोष साबित करने वाली आरडी निमेष कमीशन की रिपोर्ट को तत्काल सदन के पटल पर रखा जाए.

4- मौलाना खालिद की हत्या की सीबीआई जांच तत्काल शुरु की जाए.

5- गृह सचिव, बाराबंकी जिलाधिकारी और सरकारी वकील द्वारा बाराबंकी न्यायालय में मौलाना खालिद मुजाहिद और हकीम तारिक कासमी पर से मुकदमा वापसी की प्रक्रिया में जानबूझकर की गई आपराधिक साजिश जिसकी वजह से रिहाई संभव नहीं हो पाई, एवं मौलाना खालिद की बाराबंकी में हत्या भी हो गई, ऐसे में इन सभी शासन व प्रशासन के अधिकारियों को जांच के दायरे में लाया जाए और कार्यवायी की जाए.

6- मौलाना खालिद मुजाहिद और तारिक कासमी की 22 दिसंबर 2007 को बाराबंकी रेलवे स्टेशन से की गई फर्जी गिरफ्तारी और 18 मई 2013 को मौलाना खालिद की बाराबंकी में की गई हत्या से स्पष्ट होता है कि इस हत्या के तार बाराबंकी से गहरे जुड़े हैं, ऐसे में दिसंबर 2007 और मई 2013 के दौरान बाराबंकी के पूरे प्रशासनिक अमले को जांच के दायरे में लाया जाए.

7- 16 दिसंबर 2007 को मौलाना खालिद मुजाहिद को मडि़याहूं से अपहरण करने के बाद उच्च पुलिस अधिकारी अमिताभ यश, एसटीएफ के अधिकारियों समेत अन्य पुलिस अधिकारियों द्वारा जिस तरीके से उत्पीड़न किया गया और जिसके बारे में मौलाना ने शिकायत भी की थी, जिस पर अब तक कोई कार्यवाई नहीं हुई, ऐसे में इन दोषी पुलिस अधिकारियों के खिलाफ कार्यवाई की जाए.

8- मौलाना खालिद मुजाहिद को लगातार जेल और पेशी के दौरान जिस तरीके से एसटीएफ-एटीएस के इशारे पर स्कोर्ट द्वारा उत्पीडि़त किया जाता था और हत्या करने की धमकी दी जाती थी, और जिसकी शिकायत भी उनके अधिवक्ताओं द्वारा लखनऊ, बाराबंकी और फैजाबाद के न्यायधीशों को शिकायती पत्रों द्वारा अवगत कराया जाता था, पर इसके बावजूद कोर्ट ने इस पर कोई संज्ञान नहीं लिया और ना ही कोई कार्यवाई इन दोषी पुलिस वालों पर हुई, ऐसे में इन दोषी पुलिस अधिकारियों समेत लखनऊ, बाराबंकी और फैजाबाद के जिन न्यायधीशों ने दोषियों को बचाया उनको भी जांच के दायरे में लाते हुए कार्यवाई की जाए.

9- खालिद की हत्या के बाद जिन पुलिस अधिकारियों ने तारिक कासमी से बाराबंकी कोतवाली में दबाव देकर झूठा बयान दिलवाया कि खालिद की तबीयत पहले से खराब थी (जिसे की जेल प्रशासन और खालिद के वकील मो. शुऐब ने इंकार किया है) उन सभी अधिकारियों को जांच के दायरे में लाते हुये कार्यवायी की जाए.

10- मौलाना खालिद मुजाहिद की हत्या इस बात की पुष्टि करती है कि सरकारी एजेंसियों एसटीएफ-एटीएस और आतंकी संगठनों में गठजोड़ है जो खालिद मुजाहिद की रिहाई को लेकर भयभीत थे जिसके चलते मौलाना खालिद की हत्या कर दी गई. ऐसे में कचहरी धमाकों समेत यूपी में हुई आतंकी घटनाओं की जांच कराई जाए. जिससे खुफिया एजेंसियों, एटीएस और आतंकी संगठनों का गठजोड़ सामने आ सके.

11- उत्तर प्रदेश के जितने युवक आतंकाद के आरोप में दूसरे राज्यों में बंद हैं उनके सुरक्षा की गारंटी उत्तर प्रदेश सरकार सुनिश्चित कराए.

12-  पीडि़त परिवार को तत्काल एक करोड़ रूपये मुआवजा दिया जाए.
