New Delhi: Subramanian Swamy, Janata Party chief and Harvard Summer School economics instructor, is likely to face criminal charges for writing an article in July 16 op-ed of a news paper called DNA. The article was considered hateful towards Muslims.

In the article entitled ‘How to Wipe Out Islamic Terror’, Swamy wrote that Muslims in India “are being programmed by a slow reactive process to become radical and thus slide into suicide against Hindus.” The solution, Swamy wrote, is a unified Hindu political front.

He proposed disenfranchising of Muslims unless they proudly declared their alleged Hindu ancestry and declaring India a “Hindu Rashtra (state)”, apart from demolishing 300 mosques.

While the National Commission for Minorities (NCM) has decided to take multi-pronged action, a Delhi court ordered the city police to file a status report on a lawyer’s plea for pressing a criminal case against Swamy.

Separately, MP from Wayanad, MI Shanavas, has petitioned the National Human Rights Commission, seeking recommendations to the Centre to prosecute Swamy.

The minority rights watchdog has decided to proceed against Swamy on three grounds, including registration of a first information report.

The NCM will file police complaints against Swamy for violating sections 158 A-B (inciting violence), 295-A (malicious insult of religion) and 505 (statements constituting public mischief) of the IPC. Some of these offences are non-bailable.

It has also written to the Election Commission to deregister Swamy’s Janata Party, NCM chairperson Wajahat Habibullah told HT on Wednesday. Habibullah said the minority watchdog would also move to block Swamy’s website and other publications.

In her direction to the police, Delhi metropolitan magistrate Navita Kumari Bagha stated in her order: “The Station House Officer of Tilak Marg police station is directed to file the status report on August 16.”

Swamy’s recent article has prompted demands to have him fired from Harvard’s faculty for bigotry. Swamy teaches Economics at the Harvard Summer School. Over 260 Harvardians  have called for Swamy’s ouster in a petition due to be submitted for investigation by authorities on Monday.
