    Medha Ends Fast on 9th Day, Maharashtra Govt Accepts NAPM Demands

    Mahrashtra Government agrees to 5 major demands of the struggle and issues government resolution regarding the same.

    Mumbai: Noted social activist Medha Patkar, who was on hunger strike against the eviction of slum-dwellers from Golibar in Mumbai’s suburban Khar, broke her fast on the ninth day on Staurday afternoon after the Maharashtra Government agreed to her demands.

    The Narmada Bachao Andolan activist was on a fast from May 20 in Golibar slum area of Mumbai, where 140 acres of land has been handed to a private builder. The activist claims that signatures of slum dwellers were forged on letters of consent given for a proposed slum-rehabilitation project.

    Patkar wants the removal of Maharashtra Slum Areas Act, 1971, clause 3K that allows the state government to take over land without requiring consent of slum dwellers, investigation into all the projects sanctioned under this section and the implementation of Rajiv Awas Yojana in Mumbai.

    Talking to BeyondHeadlines, Madhuresh Kumar, an associate of the activist and a member of National Alliance of Peoples’ Movement (NAPM), said: “Medha has ended her fast after District Magistrate Nirmal Deshmukh came up with a notification. They have agreed to her demands.”

    “The government has agreed to constitute two new joint committees with representatives of the civil society. One would look into the Ganesh Kripa Housing Society issue and would submit its report on June 15,” Kumar said.

    The second committee would investigate 15 slum areas where 3K clause of Maharashtra Slum Act has been used and submit a report in four months, he said.

    On May 20, when the homes were being demolished in the Ganesh Krupa Society, she was detained on her way to the site of demolition.
    Patkar broke her fast by accepting lemon juice from 80-year-old Akanksha Bai, a resident of the Ganesh Krupa Housing Society, who was in jail for resisting demolition.

    Akanksha told BeyondHeadlines: “It is a victory of the lakhs of people fighting for their right to live in the financial capital of India with dignity. The real fight is about the right over land of the poor who make this city what it is. Today, the land is being given or grabbed by the builders and influential people like Mukesh Ambani who has built his 27 storey building on the land of Waqf Board.”

    She said that about 33,000 acres of land, which was either encroached or free, was now available after the Land Ceiling Act had been revoked. “After September 30, when the work of these committees would be over, we will launch Land Haq Satyagraha (land owner struggle) in Mumbai to capture the government land for the poor of the city. Our Chief Minister Prithviraj Chauhan has a bigger battle ahead and against a powerful lobby. If he intends to fight it, we are with him, or else we are on the path of struggle and justice and dignity for poor.”

    Syed Zuber, fasting for the 5th day, said: “What we have achieved today here only shows that if people together come and fight, nothing seems impossible. When we met the chief secretary three days ago and the way he talked to us further boosted our resolve that we have to take the fight to the finish.”

    Another protester Simpreet Singh also told BeyondHeadlines: “The fight is against making this city of the working class, for the working class and by the working class and not of the builder, for the builder and by the builder. With the Adarsh Housing Society, we showed to the country the kind of nexus between politicians, builders and bureaucracy is going on in Mumbai. We have a long battle ahead to get the recommendations of these committees implemented.”

    Mumbai: Even though the Maharashtra government offered to probe the controversial slum projects, activist Medha Patkar will continue her fast as the former failed to promise a time-bound inquiry as demanded by her. The five-hour-long meeting between chief secretary Ratnakar Gaikwad and Patkar on Wednesday, failed to yield any result. Patkar, who has been on indefinite hunger strike since last Friday, has been demanding changes in the slum rehabilitation policy and probe into slum projects including the one at Golibar near Khar.

    Refusing the proposal to break the fast, Patkar said, “I will continue my fast till the government agrees to our demands and gives a written commitment.”

    The activist sought an inquiry by the high power committee in a time-bound manner. The panel was set up in 2005 and consists of four members of the NAPM, but has met only four times.

    The meeting took place in two sittings. In the first sitting, Gaikwad agreed to discuss the implementation of the Rajiv Awas Yojana, an inquiry in the Golibar redevelopment and other projects under controversial 3K clause of the Maharashtra Slum Areas Act, 1971, and stay on the demolitions at Ganeshkripa Society till the inquiry is over. “We will probe the ongoing projects under this section. A decision about the 3K section can be sought accordingly,” he said.

    The second sitting, however, ended on an ugly note after Patkar walked out from the meeting citing dissatisfaction over oral assurances from the government.

    People from nook and corner of the state have joined in relay fasting. Many eminent personalities and social activists like Anna Hazare, Swami Agnivesh, GR Khairnar and Arvind Kejriwal have extended support to Medha Patkar.

    Organizations like Republican Panthers, Ekveera Sez Virodhi Sangharsh Samiti, Tata Dharan Grast Sangharsh Samiti, farmers from Malegaon, Chemical Mazdoor Sabha, Shramik Janta Sangh, India Against Corruption, Brihan Mumbai Niwas Abhiyan Samiti, SUCI, Lok Jagran Manch, Brihanmumbai Nivara Abhiyan Samiti, and many others have joined the protest.

    Apart from Delhi and Aurangabad, demonstrations were also held in Thrissur and Calicut. Similar events are being planned in Uttar Pradesh, Karnataka, Tamilnadu, Andhra Pradesh, West Bengal, Kerala and other places. Supporters have also started an online petition addressed to Chief Minister of Maharashtra, Prime Minister and Smt. Sonia Gandhi, President INC. International support is also being mobilized and emails are being sent to the CM demanding for putting a moratorium to all demolitions until an independent enquiry is held in to the 3k clause related projects and SRA is completely reviewed.

    New Delhi: The enquiry commission constituted by the Maharashtra Government to investigate the much talked Adarsh Housing Society scam all set to start proceedings this week.

    the state government had formed the commission in December 2010 under the leadership of former High Court Justice J A Patil. Ex-Chief Secretary P Subramanian is also included in the panel as its member to probe the alleged irregularities in allotment of plot and grant of additional FSI to Adarsh Society.

    “The Commission was expected to submit its report within three months from January 8. However, we got all the resources including accommodation in February. We have started getting affidavits from the members of the society and various departments of the government,” an official attached to the Commission said.

    An extension of time would be sought, he added.

    The Commission’s probe would run parallel to the inquiry by CBI, which has registered a case against 13 accused, including former chief minister Ashok Chavan, for criminal conspiracy, fraud and misuse of the official powers.

    The Commission would look into issues such as whether the land was reserved for kin of Kargil war martyrs, alleged violation of Coastal Regulation Zone rules, etc.

    In 2010, serious violations of rules at various phases of construction in the Adarsh Society came to the fore. Questions were raised on the manner in which apartments in the building were allocated to bureaucrats, politicians and army personnel who had nothing to do with Kargil War and the way in which clearances were obtained for the construction of the building of the Adarsh Society. The Adarsh society high-rise was constructed in the posh Colaba locality of Mumbai, which is considered a sensitive coastal area by the Indian Defence forces and houses various Indian Defense establishments. The society is also alleged to have violated the Indian environment ministry rules. Many activists like Medha Patkar had been trying to uncover this scam since a long time. The exposure of the infamous nexus between politicians, bureaucrats and builders in this scam is said to be only the tip of the iceberg. It had led to resignation of the then Chief Minister, Ashok Chavan.

    Several inquiries have been ordered by the army and the government to probe into the irregularities. Some of the current occupants of the flats in the Adarsh co-operative society building have offered to vacate their flats at the earliest, denying allegations that they were alloted flats because they influenced or helped, in some manner, the construction of the society by violating the rules. It was also exposed that the lower house of the Indian Parliament was misled by one of the bureaucrats, Pradeep Vyas, involved.

    The environment minister Jairam Ramesh formally set the ball rolling for the demolition of the entire 31-story scam-tainted Adarsh building in Coloba’s eco-sensitive zone on Friday November 12, 2010. The environment minister is said to have sent a show cause notice to the Adarsh housing society. The environment minister is said to have stated that “all options under the law are open except regularization of the structure.” As per the Ministry of Environment and Forests’ order dated January 16, 2011, “the unauthorised structure should be removed in its entirety and the area restored to its original condition.”
