New Delhi: The Indian Community Action Network (ICAN) raises its voice against abrogation of Article 370 and Article 35A in relation to Jammu & Kashmir in the way it has been done by the present Government of India. ICAN, in general, does not agree with the tendency of taking decisions regarding the area or status of a state without consulting the people, their elected representatives and the elected Government of the state.

ICAN, in a press release, said that, though the Article 370 of the Indian constitution provided constitutional special status to the state of Jammu and Kashmir, it also denied the people of the state to access and use Indian legal provisions (EPA, FRA etc.) to protect their life, livelihood and natural resources.

It further holds that the Article 35A of the Indian constitution which had been applicable to Jammu and Kashmir served to some extent in thwarting the land sharks from having an all-out effort to grab land and landed property in Kashmir. But it too had a very regressive provision of denying the Kashmiri women marrying outsiders their right to ancestral land and landed property.

ICAN notes with concern the announcements made by the Ministers of the Government of India to flood the Kashmir valley with a surge of development as this means an intensification of destruction and loot of natural resources by corporate and business houses experienced day in and day out by the people of India in all other states.

It calls for an immediate end to violence in Kashmir. Creating a congenial atmosphere to enable people to raise their demands in a peaceful manner and restoring the functioning of democratic institutions in the valley is the need of the hour.
