    Hindu far-right weaponizing festivals to target Muslims

    Festivals are meant to bring happiness, bring people together, and foster brotherhood and harmony. The Indian Constitution also gives us the right to practice our religion. However, in the last few years, widespread hatred has changed many things, and the obvious result is growing tension in society. Hatred is spread particularly during festivals, be it the festival of any community. This time again, Muslims were targeted on the Bakrid festival, which teaches the spirit of sacrifice. In some places, Muslims were not allowed to sacrifice an animal; in others, they were attacked, lynched, and harassed. I have tried to collect and compile a few incidents that were reported in the media.

    Some of the events reported by media websites include:

    Chhapra: On Wednesday, June 28, just a day before Bakrid, a 55-year-old Muslim truck driver, Muhammad Zaheeruddin, was beaten to death by a Hindu extremist mob in the presence of the police, on a road passing through Bangra village (on the river) under Jalalpur police station area, Chhapra district, Bihar. This Hindu extremist mob accused the truck driver of being a Muslim and trading bones and meat before Bakrid, whereas the truck was carrying bones to a factory that makes medicinal ingredients. Cattle bones are used to make gelatin for the pharmaceutical industry.

    Silchar: On the day of Bakrid in Silchar, Cachar district of Assam, a clash broke out between two communities over ‘sacrifice’ near Panchayat Road. There is news of many people getting injured in this clash. During this time, many vehicles were also damaged. To control the situation, the police had to lathi-charge. Tension flared up again after two Muslim families were allegedly attacked in two separate incidents.

    Gwalior: Workers of Bajrang Dal and Hindu organizations reached late Thursday night on the occasion of Bakrid at Panpatteki Goth of Madhav Ganj police station area in Madhya Pradesh’s Gwalior district and alleged that cattle were sacrificed here. On getting the information, top police officers also reached the spot along with the force. Nearby CCTV footage was searched, but the sacrifice of the cow could not be confirmed. However, in the initial investigation by the police, buffalo meat has been recovered and has been sent to the lab for investigation.

    Khandwa: On the day of Bakrid in the Khandwa district of Madhya Pradesh, workers of Vishwa Hindu Parishad and Bajrang Dal thrashed two people in the Anand Nagar area of the city. It is alleged that they were carrying about 30 kg of meat. The police have registered a case and sent the seized meat for forensic examination.

    Hindu organizations created a ruckus in the name of allegedly teaching Kalma (Islamic prayer/phrase recited by Muslims) in a missionary school in Khandwa. While the school’s principal, Victoria, says that her school celebrates all the festivals of the country. In this sequence, during the prayer meeting a day before Bakrid, four Muslim children were called on stage, and they were asked to tell the rest of the children about the festival of Bakrid. These four children also recited a Kalma in the same sequence.

    Kanpur: A case has been registered against 40 unknown people for the “crime” of offering Bakrid prayers on the road outside the mosque in the Jajmau police station area of Kanpur, Uttar Pradesh. Police say that despite the ban, prayers were offered on the road. In this matter, the police have registered a case against more than 40 people, started an investigation, and are taking further legal action.

    Bareilly: On the complaint of the Gram Pradhan and the villagers, the police stopped the Muslims here from performing the sacrifice in the village Churai Dalpatpur under the Meerganj police station area of Bareilly, Uttar Pradesh. Hundreds of people from the Muslim community kept demanding that the sacrifice be allowed, but the police said that the new tradition would not be allowed to happen at any cost. After this, police were deployed in the village so that the atmosphere did not deteriorate. According to the police, this village has a 30 percent Muslim population.

    Meerut: Three Muslim brothers living in Ismail Nagar in the Khatauli area of Muzaffarnagar district of Uttar Pradesh were going to Hapur with goat skin. The tire of his car got punctured near the toll plaza on NH 58. Meanwhile, some goons of Bajrang Dal reached there and accused them of carrying beef and started beating them. Meanwhile, the police also reached there. On the complaint of these three youths, the Meerut police arrested six people, including the district-level leader of Bajrang Dal. At the same time, two injured Muslim youths were immediately admitted to the hospital, and their condition is stable.

    Ghaziabad: Bajrang Dal workers thrashed two people in Ghaziabad, Uttar Pradesh. He is accused of carrying beef in his canter. Both of the injured have been admitted to the hospital. According to the police, a veterinarian has been called to examine the meat.

    In another incident, Bajrang Dal workers thrashed three Muslim truck drivers and cleaners carrying animal remains. A video in this regard has been shared by the Twitter handle Hindutva Watch, which states that these people were “carrying animal remains to a factory in Delhi’s Ghazipur that manufactures cat and dog food.”

    Solapur: In Maharashtra’s Solapur city, an attempt has been made to create Hindu-Muslim tension on the day of Bakrid. Such balloons were being sold near Shahi Alamgir Idgah here, on which ‘Love Pakistan’ was written. On the complaint of the Muslims here, the police arrested the person selling balloons, whose name is Ajay Pawar. Police say that they are trying to find out from Ajay Pawar where he got the balloons from.

    On the same day, Two Muslim men were stripped, tied to a tree, and brutally beaten by around 30-40 members of the Hindu militant group Bajrang Dal over suspicion of cattle slaughter. They were also forced to chant the Hindu religious slogan “Jai Shree Ram,” which is used as a warcry by Hindu supremacists.

    The news also came from Solapur that the Muslims of the Pandharpur temple had announced not to sacrifice on the first day of Bakrid to avoid tension on Ashadha Ekadashi. An event is held every year in the Vitthal-Rukmini temple located at Pandharpur in Solapur district, which this time fell on the first day of Bakrid, in which lakhs of devotees come from almost every part of Maharashtra.

    Mumbai: A Muslim family living in a housing colony in Maharashtra’s Mumbai city was branded “terrorists” and attacked by a mob of Hindu extremists for bringing two goats into their home. Muslim couple Mohsin Khan and Yasmin Khan said that “If bringing the goats inside the housing colony was against the law, then they should have filed a police complaint against us. We were assaulted, molested, and mentally harassed by the mob that gathered to protest against us.”

    In another housing society in Mumbai, there was a ruckus in another society of Mumbai regarding the keeping of the sacrificial goat on Bakrid. After which, BMC shifted these goats to another place.

    Badrinath: Some Hindu organizations here have demanded that Bakrid Namaz not be offered in any area of Badrinath Dham in Uttarakhand and also warned that if Bakrid is celebrated here, they will start agitation. Religious beliefs were said to be the basis for this warning. The police here also stated the same argument. In such a situation, the Muslims here had to go to the neighboring town of Joshimath, about 40 kilometers from Badrinath, to offer Eid prayers.

    Uttarkashi: Due to the Vishwa Hindu Parishad in the Purola town of Uttarkashi in Uttarakhand, the Muslims here could not offer Bakrid prayers. The Muslims living here had to go to Sandra or Vikasnagar, about 30 km from here, to offer Namaz.

    Hyderabad: When a Muslim family brought a bull for sacrifice on Bakrid in the Lingampalli area of Hyderabad, local people, including Bajrang Dal and BJP leaders, barged into their house and forcibly dragged the animal out. These people argued that blood and animal waste would spread on the road and create problems. On getting information about this, the police reached the spot with a heavy police force and took the bull to some other place.

    Hassan: Hindutva activists created a ruckus at Gyansagar International School in Channarayapatna town of Hassan district, Karnataka, a day before Bakrid, alleging that the school students offering Namaz. However, the school management has clarified that no namaz has been offered at the school. Some Muslim children were asked to recite verses from the Quran. And this was done to create harmony and integrity and not only Bakrid; such cultural programs are organized on the occasion of all the festivals of different religions.

    Bidar: In Basavakalyan, Bidar district of Karnataka state, a BJP legislator, Sharanu Salagar, and about 15-25 supporters barged into the Muslim man’s home while he and his family were celebrating Eid, screaming that they were slaughtering a cow inside their house.

    Shivamogga: In two separate incidents in Karnataka’s Shivamogga district, the police have detained two persons for allegedly carrying beef. In the first incident, Hindu activists detained a vehicle in Punedahalli, carrying cowhide, and took it to Shikaripura police station. In the second incident, Shiralakoppa police had detained a person for allegedly transporting beef. According to the police, an inquiry had been initiated against both incidents.

    Gujarat: On the occasion of Bakrid, two cases have come to the fore in schools where children were allegedly made to practice offering Namaz. One of these cases is Kutch’s, and the other is Mehsana’s. In both places, a lot of uproars were created regarding this matter through the Hindutva organizations like Vishwa Hindu Parishad and Bajrang Dal. After the incident came to light, the District Education officer ordered an inquiry into the matter.

    Srinagar: In the historic Jamia Masjid and Idgah of Srinagar, Jammu and Kashmir, permission was not given to offer Bakrid prayers this year as well. Earlier in April, Eid prayers were not allowed at the historic Jamia Masjid in Srinagar.

    अब महाराष्ट्र में लिंचिंग की कोशिश, लगवाए गए ‘जय श्री राम’ के नारे

    झारखंड के भीड़ हिंसा में तबरेज़ अंसारी की मौत पर देश भर में विरोध जारी है. तबरेज़ को इंसाफ़ दिलाने के लिए देश के हर कोने से आवाज़ें उठ रही हैं. इसी दौरान मुंबई से सटे ठाणे ज़िला के दिवा में बदमाशों ने ओला के एक मुस्लिम ड्राइवर की बुरी तरह पिटाई कर के ज़बरदस्ती ”जय श्री राम” कहने पर मजबूर किया. तेज़ी से बढ़ते हुए इस ख़तरनाक ”ट्रेंड” पर रोक नहीं लगाई गई तो मज़हबी नफ़रत भारत के लिए एक कलंक बन जाएगी.

    मीडिया रिपोर्ट्स के अनुसार मुंब्रा में रहने वाले एक 22 वर्षीय ओला ड्राइवर फ़ैसल उस्मान ख़ान का कहना है कि ‘मैं अपनी गाड़ी लेकर जा रहा था कि तीन शराबियों ने स्कूटी से मेरी गाड़ी को टक्कर मारी और मराठी में गाली देते हुए कहा कि तुम्हारे बाप का रोड है? कुछ कहासुनी के बाद लात घूंसों से प्रताड़ित करने के अलावा रॉड से मेरी पिटाई की. शारीरिक चोटें लगने पर मैंने उनसे कहा कि अल्लाह के वास्ते मुझे मत मारो वर्ना मैं मर जाऊंगा तो एक ने कहा कि यह तो मुसलमान है.’

    ‘उसके बाद उन्होंने गाड़ी से घसीट कर बाहर निकाला और तीनों ने बेतहाशा पिटाई करते हुए जय श्री राम कहने पर मजबूर किया.’ फ़ैसल ने सूझबूझ का परिचय देते हुए 100 नंबर डायल कर पुलिस को सूचना दी और अपनी जान बचाने में कामयाब रहा. लेकिन कट्टरपंथी भीड़ के हाथ लगने वाला हर इंसान फ़ैसल जैसा ख़ुशनसीब और समझदार नहीं होता. स्वागत योग्य पहलू यह है कि तीनों बदमाशों (मंगेश मुंडे, अनिल सूर्यवंशी और जयदीप मुंडे) को गिरफ़्तार कर लिया गया है. इस मामले में त्वरित पुलिस कार्रवाई की सराहना की जानी चाहिए.

    इस वक़्त हमें ऐसे शांतिपूर्ण माहौल की ज़रूरत है जहां हर धर्म हर विश्वास के मानने वाले भारत में ख़ुद को पूरी तरह सुरक्षित महसूस करें. जनता के जान-माल की रक्षा और जनता को शांतिपूर्ण माहौल मुहैया कराना ज़िला प्रशासन और पुलिस विभाग की संयुक्त ज़िम्मेदारी है, जिसके लिए सरकार का सहयोग बहुत ज़रूरी है. आज भीड़ की शक्ल में निर्दोष लोगों को बेरहमी से मार देना आसान हो गया है और ‘जय श्री राम’ कहकर हमलों को सही ठहराया जा रहा है.

    झारखंड के खरसावां ज़िले में भीड़ ने तबरेज़ अंसारी को चोरी के आरोप में बिजली के पोल से बांधकर कथित तौर पर घंटों पीटा और ‘जय श्री राम’ और ‘जय हनुमान’ के नारे लगवाए. बाद में अस्पताल में तबरीज़ की मौत हो गई. पुलिस ने इस मामले में 11 लोगों को गिरफ़्तार किया है और दो पुलिसकर्मी निलंबित किए गए हैं. मामले की जांच के लिए एसआईटी का गठन किया गया है. तबरेज़ पर चोरी का आरोप है. मान लिया कि वह चोर है तो क्या अब चोरों को ‘जय श्री राम’ का नारा लगाकर मारा जाएगा? क्या देश में क़ानून का राज होने के बाद भी भीड़ का राज क़ायम है?

    तबरेज़ को मारती हुई भीड़ को जब मालूम हुआ कि यह मुसलमान है तो उससे जय श्री राम और जय हनुमान के नारे लगवा लेना चाह रही थी. एक ही मुंह से गालियां भी निकल रही थीं और भगवान का नाम लेने की ज़िद भी. तबरेज़ इतना लहूलुहान हो चुका था कि उसके मुंह से कुछ बोला नहीं जा रहा था. पिटाई के बाद जुनूनी भीड़ ने तबरेज़ को पुलिस के हवाले कर दिया. फिर जो हुआ उसे पूरी दुनिया बख़ूबी जानती है.

    तबरेज़ की घटना को ‘घिनौना जुर्म’ क़रार देते हुए अल्पसंख्यक मंत्री मुख़्तार अब्बास नक़वी ने कहा, ‘लोगों का गला दबाकर नहीं बल्कि गले लगाकर ‘जय श्री राम’ का नारा लगाया जा सकता है. जो लोग इस तरह की चीज़ें करते हैं उनका मक़सद सरकार के सकारात्मक काम को प्रभावित करना है। कुछ घटनाएं हो रही हैं, उन्हें रोका जाना चाहिए.’ 

    इस युवक की मौत के एक सप्ताह बाद प्रधानमंत्री मोदी ने अपनी चुप्पी तोड़ते हुए सिर्फ़ अफ़सोस व्यक्त किया. उन्होंने कहा कि ‘भीड़ हिंसा की वारदातें दूसरे राज्यों में भी पेश आती हैं, इसलिए झारखंड को बदनाम न किया जाए और दोषियों को सख़्त सज़ा दी जाए.’

    लेकिन प्रधानमंत्री की कथनी और करनी में विरोधाभास नज़र आता है. क्योंकि हिंसा पर उतारू बदमाशों के ख़िलाफ़ कोई सख़्त कार्रवाई बज़ाहिर अब तक नज़र नहीं आई. पर्यवेक्षकों का मानना है कि इस घटना के बाद क़ानूनी स्तर पर जो कार्रवाई हुई या हो रही है उसमें भी धार्मिक नफ़रत की बुनियाद पर न्याय की अवधारणा को पामाल किया जा रहा है. इस मामले में पुलिस ने जो रिपोर्ट लिखी है उसमें तबरेज़ का ये इक़बालिया बयान तो शामिल है कि उसने मोटर साइकिल चोरी की थी लेकिन उसके साथ जो हिंसा हुई उसका कहीं कोई ज़िक्र नहीं है. मतलब जिन लोगों को गिरफ़्तार किया गया है, कल को उन्हें बाइज़्ज़त रिहा कर दिया जाएगा?

    ग़ौरतलब है कि भीड़ हिंसा के मामले में झारखंड का रिकॉर्ड पिछले कुछ वर्षों में बहुत ही ख़राब रहा है. यहां भीड़ हिंसा के कई मामले सामने आ चुके हैं. यहां भाजपा की सरकार है. यह वही झारखंड जहां गौहत्या के आरोप में अलीमुद्दीन अंसारी का क़त्ल कर दिया गया था और हत्यारे को जब कोर्ट से ज़मानत मिली तो मौजूदा केंद्र सरकार के एक मंत्री ने उन दोनों अपराधियों का माला पहना कर अभिनंदन किया था. जब केंद्रीय मंत्री हत्यारों की वाहवाही करे तो हत्यारों के हौसले बुलंद ही होंगे, पस्त नहीं. मॉब लिंचिंग के दोषियों को वर्तमान सरकार की ओर से खुली छूट मिली है जिसका वह भरपूर फ़ायदा उठा रहे हैं.

    तबरेज़ की मौत से ठीक पहले दिल्ली में एक मस्जिद के इमाम पर हमला और ‘जय श्री राम’ का नारा लगवाने की ख़बर आई. पुलिस ने उसे दुर्घटना का मामला बताया जबकि वो बार-बार यह कह रहा था कि उसकी धार्मिक पहचान की वजह से उस पर हमला किया गया. 

    कल तक हम महसूस करते थे कि यह बीमारी फ़िलहाल बड़े शहरों से दूर है लेकिन दिल्ली और मुंबई जैसे शहरों में होने वाली घटनाओं ने हमें बहुत कुछ सोचने पर मजबूर कर दिया है. चरमपंथियों ने मुसलमानों के ख़िलाफ़ नफ़रत का जो बीज बोया था वह अब फलने फूलने लगा है.

    वैसे तो भारत में राम के नाम पर राजनीति एक ज़माने से हो रही है. लेकिन अब यह ”जय श्री राम” के नारे के साथ बेहद ख़तरनाक रुख़ अख़्तियार कर चुकी है. संसद में इस नारे का उपयोग विपक्ष को नीचा दिखाने के लिए किया गया. फिर संसद के बाहर यही नारा लगाते हुए तबरेज़ को धर्म के आधार पर इतना मारा गया कि उसकी मौत हो गई. 

    यह बात समझ से परे है कि आख़िर क्यों आप ‘जय श्री राम’ को एक राजनीतिक नारा बना रहे हैं? और आश्चर्यजनक रूप से हिंदू धर्म के नेता बिल्कुल चुप हैं? क्या यह खुलेआम श्रीराम का अपमान नहीं है? क्या राम को राजनीतिक चेहरा बनाकर हंगामा बरपा करना ”रामायण” के साथ अन्याय नहीं है?

    पिछले पांच सालों में अल्पसंख्यक विशेषकर मुसलमानों के ख़िलाफ़ भीड़ हिंसा में बिजली की रफ़्तार से वृद्धि हुई है. 2015 में गौरक्षा के आरोप में दादरी में अख़लाक़ अहमद की बेरहमी से हत्या के बाद से लेकर अब तक सिर्फ़ भीड़ हिंसा और नफ़रत पर आधारित अपराध का निशाना बनने वाले अल्पसंख्यक समुदाय के लोगों की समग्र संख्या एक सौ पार कर चुकी है जबकि उनमें से 30 से अधिक की मौत हो चुकी है. ये आंकड़े विदेशी समाचार एजेंसी रॉयटर्स के हैं और यह बात पक्की है कि यह सरकारी सूचना पर आधारित होंगे जबकि ग़ैर सरकारी तौर पर देखा जाए तो यह संख्या काफ़ी बढ़ चुकी होगी.

    सोचने वाली बात है, पहले भीड़ हिंसा में मुसलमानों को निशाना बनाया जाना, नाम जानकर या उनकी पहचान के बारे में पता होने पर उन्हें विभिन्न धार्मिक नारे लगाने पर मजबूर करना. देश के विभिन्न भागों में इस तरह की घटनाओं को अंजाम देना और फिर उसकी बाक़ायदा वीडियो क्लिप बनाना और फिर उसे सोशल मीडिया पर अपलोड किया जाना और फिर अनगिनत व्हाट्सप्प ग्रुप्स में फैलाकर वायरल किया जाना. फिर टेलीविज़न द्वारा नफ़रत के ज़हर को घर घर तक पहुंचाना. यह सब एक सुनियोजित तरीक़े से किया जा रहा है ताकि मुसलमान पूरे देश में मनोवैज्ञानिक और मानसिक रूप से डरे और सहमे हुए ज़िंदगी गुज़ारने पर मजबूर हो जाएं.

    विश्व स्तर पर देश की छवि काफ़ी हद तक धूमिल हुई है और इसके ज़िम्मेदार वे लोग हैं जो देश के सबसे बड़े वफ़ादार बनने का ढोंग करते हैं और दिन रात देशभक्ति का दम भरते रहते हैं. हाल ही में अमेरिका ने धार्मिक स्वतंत्रता के संबंध में अंतर्राष्ट्रीय स्तर की अपनी रिपोर्ट में चिंता जताई है कि हाल के वर्षों में भारत में भीड़ हिंसा में वृद्धि हुई है और एक ख़ास वर्ग निशाना बन रहा है. उस रिपोर्ट में इस तथ्य को दर्शाया है कि देश में रहने वाले मुस्लिम अल्पसंख्यक के अंदर दहशत का माहौल है. इससे पहले भी अमेरिका की एक रिपोर्ट में यह ख़ुलासा किया गया था.

    भीड़ हिंसा दरअसल संविधान पर हमला है. अतिवादी इसके द्वारा यह संदेश देना चाहते हैं कि इस देश में इस तरह की घटनाओं को अंजाम देने वाले आज़ाद हैं और अगर इस देश में रहना है तो इसी तरह के माहौल में जीना होगा. यह सिर्फ़ दो मज़हब के मानने वालों में फूट पैदा करने के लिए किया जाता है, जिसकी जितनी निंदा की जाए कम है. जब तक जाति, धर्म और सांप्रदायिकता से ऊपर उठकर इस तरह की वारदात का विरोध नहीं किया जाएगा तब तक प्रशासन यूंही मूकदर्शक बना रहेगा और भीड़ ऐसी वारदात को अंजाम देती रहेगी.

    चाहे वह झारखंड का मामला हो या दिल्ली और ठाणे के दिवा का हमला, तीनों में निर्दोषों को निशाना बनाया गया. यह दमन और धार्मिक ज़बरदस्ती की नई शक्ल है. इन घटनाओं से समाज में फूट पैदा हो रही है जो किसी क़ीमत पर देश के लिए फ़ायदेमंद नहीं. पूरी हिम्मत के साथ इसका विरोध होना चाहिए. इस खुले आतंकवाद से मज़बूती से लड़ा जाना चाहिए इससे पहले कि यह पूरी तरह से नियंत्रण से बाहर हो जाए. पागल भीड़ को रोकने के लिए यह भी आवश्यक है कि मौजूदा सरकार देश के सभी नागरिकों के प्रति जवाबदेह हो और अपने संकल्प के प्रति गंभीर और अपने काम में तटस्थ हो.

    बहरहाल, मॉब लिंचिंग को पृथक अपराध की श्रेणी में रखने की वकालत करते हुए सुप्रीम कोर्ट पहले ही ख़बरदार कर चुकी है कि इसकी रोक थाम के लिए सरकार जल्द ही एक नया क़ानून बनाये. इस बात को लगभग एक साल का समय बीत चुका है लेकिन अफ़सोस सरकार भीड़ हिंसा रोकने में अभी भी संजीदा नहीं है. इसकी बिल्कुल स्पष्ट और सीधी वजह यही है कि पहले गाय के नाम पर निर्दोष लोगों को बेरहमी से पीट-पीटकर मारने वाले और अब ज़बरदस्ती ‘जय श्री राम’ और ‘जय हनुमान’ के नारे लगवाने वाले, दोनों एक ही तरह के राजनीतिक समाज से आते हैं.

  • SOUTHERN COMMAND CONDUCTS INVESTITURE CEREMONY AT GATEWAY OF INDIA, MUMBAI

    On the auspicious occasion of 67th Army Day, Southern Command Investiture Ceremony was conducted at Gateway of India, Mumbai on January 15 under the aegis of HQ MG & G Area.  Lieutenant General Ashok Singh . General Officer Commanding-in-Chief Southern Command, felicitated 30 officers and three jawans with gallantry and distinguished service awards. These awards have been given to the awardees for acts of bravery, exceptional devotion and service to the Nation.

    These awardees include eight Sena Medals (Gallantry), four Yudha Seva Medals, one Bar to Sena Medal, six Sena Medals (Distinguished) and eight Vishist Seva Medals. The Army Commander also bestowed Unit Citation to 14 units of Southern Command for their meritorious and outstanding performance.   The ceremony was graced by a large number of civil and military dignitaries.

    The General Officer-in-Chief Commanding, Southern Command, Lieutenant General Ashok Singh while speaking at the ceremony congratulated all the awardees and recipients of Unit Citations.   He called upon all ranks to emulate the awardees and do their best to project the name, fame and glory of Indian Army and the Nation.

    The Investiture Ceremony was followed by Beating the Retreat ceremony.   An amazing display of skills including lezium was presented by soldiers of Maratha Light Infantry Regimental Centre, Belgaum. The glittering event concluded with a rousing Band Symphony. The martial music played by the combined bands of Artillery Centre, Nasik Road and BEG & Centre, Pune left the audiences spell bound.

    1993 के मुंबई बम ब्लास्ट मामले में 20 साल बाद सुप्रीम कोर्ट का फैसला आया है. अवैध हथियार रखने के आरोपी संजय दत्त की सजा को सुप्रीम कोर्ट ने एक साल कम करके 5 साल कर दिया है. संजय दत्त इस मामले में 18 महीने जेल में रह चुके हैं और सुप्रीम कोर्ट के फैसले के बाद उनका एक बार फिर जेल जाना तय हो गया है.

    इस फैसले के बाद से ही संजय दत्त के पक्ष में तर्क दिए जा रहे हैं. उनके चरित्र और समाजसेवा का हवाला देकर उन्हें जेल न भेजने की दुहाई दी जा रही है. कानून की गहन जानकारी रखने वाले जस्टिस काटजू जैसे लोग भी कानूनी प्रावधानों का हवाला देकर उनकी रिहाई के रास्ते सुझा रहे हैं.

    यही नहीं, राजनीतिक पार्टियों ने भी उन्हें जेल न भेजने की बात कही है. लेकिन इस वक्त देश जो सबसे बड़ा सवाल पूछ रहा है वह यह है कि क्या संजय दत्त को कांग्रेसी सांसद प्रिया दत्त का भाई, पूर्व कांग्रेसी नेता और दिग्गज अभिनेता सुनील दत्त का बेटा या फिर स्वयं एक प्रसिद्ध अभिनेता होने के नाते छोड़ दिया जाए..?

    यह सवाल तब और बड़ा हो जाता है जब भारत की जेलों में हजारों कैदी सजा पूरी हो जाने के बाद भी बंद हो. संजय दत्त के लिए आवाज़ उठाने वालों की कोई कमी नहीं है. अभिनेता, क्रिकेटर, नेता, बड़े पत्रकार, पूर्व जज और सामाजिक राजनीतिक कार्यकर्ता हर संभव मंच से उन्हें जेल न भेजे जाने की वकालत कर रहे हैं.  सबके पास अपने-अपने कारण है, किसी को उनकी फिल्मों में लगे प्रोड्यूसरों के पैसे की चिंता है तो कोई कह रहा है कि वह पहले ही अपने किए की सजा भुगत चुके हैं. लेकिन किसी ने 71 साल की जै़बुन्निसा अनवर काज़ी के बारे में नहीं सोचा. मुंबई बम धमाकों के मामले में सुप्रीम कोर्ट ने उनकी सजा भी पांच साल तय कर दी है. जबकि ज़ैबुन्निसा का कसूर इतना था कि संजय दत्त तक जो एके-56 पहुंचाए गए, वह उनकी टूटी दीवारों वाली खोली में कुछ समय के लिए रखे गए थे. यही हथियार फिर संजय दत्त को दे दिए गए. पर ज़ैबुन्निसा न तो अबू सलेम को जानती थी, न अनीस को और न ही दाऊद को. उसने तो एके-56 को नष्ट करने का ठेका भी नहीं दिया था. पर सजा उसे बराबर ही हुई है. पर वो बेचारी क्या करे क्योंकि देश की दशा और दिशा तय करने वाले दिग्विजय सिंह उसे जानते तक नहीं हैं. काटजू साहब के पास संविधान की जो मोटी किताब मौजूद है, उसमें उसका नाम तो प्रस्तावना से ही खारिज किया जा चुका है.

    जिस देश में संजय दत्त को जेल न भेजे जाने के लिए हर कोने से आवाज़ उठ रही हो उसी का एक काला सच यह भी है कि  इसी देश में लोग 14-15 से अधिक का समय जेल में काटते हैं, तरह-तरह की यातनाएं झेलते हैं, और फिर अदालत  बेगुनाह क़रार देती है. लेकिन तब न तो कोई नेता मुंह खोलता है और नही कोई सामाजिक कार्यकर्ता. लेकिन यदि किसी क्रिकेटर या कलाकार पर न्याय की तलवार लटके तो सभी के मुंह खुल जाते हैं.

    संजय दत्त के मसले पर मानवाधिकार कार्यकर्ता हिमांशु कुमार कहते हैं कि किसी की सज़ा को लेकर सियासत किया जाना दुर्भाग्यपूर्ण है. ज़रा कल्पना कीजिए कि अगर संजय दत्त की जगह पर मुम्बई का कोई मुसलमान होता तो क्या उसकी सज़ा की माफी की बात की जाती? देश का कानून सबके लिए बराबर होनी चाहिए. अब अगर कोई संजय दत्त की वजह से उसके सज़ा की माफी की बात करता है तो यह काफी दुखद है. और हमारे  काटजू साहब जो खुद ही एक जज रहे हैं, उनके मुंह से ऐसी बातें शोभा नहीं देती.

    वहीं, एसोसिएशन फॉर प्रोटेक्शन ऑफ सिविल राईट्स के राष्ट्रीय संयोजक अखलाक अहमद का कहना है कि इंसाफ की देवी के आंखों पर काली पट्टी और तराजू इसलिए होता है कि वो किसी के साथ भेदभाव न करे. कानून की नज़र में सब बराबर हैं. कानून ने तो पहले से ही संजय दत्त के कद से प्रभावित होकर कम से कम सजा सुनाई है. अब इसमें भी सज़ा की माफी की बात करना सही नहीं है. वैसे भी उनका क्राईम कोई कम छोटा नहीं है. यहां तो बेगुनाह बच्चे भी 14 सालों से अधिक जेल की सजा काट रहे हैं.

    संजय दत्त को जेल न भेजने की मांग कर रहे लोगों को नेशनल क्राईम रिकार्ड ब्यूरो के आंकड़े शर्मसार कर देंगे.  2011 तक 68935 लोग देश के अलग-अलग जेलों में अलग-अलग मामलों में उम्र कैद की सज़ा काट रहे हैं. पर किसी ने उनके बीवी- बच्चों के बारें में कभी किसी ने कुछ भी नहीं सोचा. यही नहीं, 15053 लोग 13 सालों से अधिक वर्षों से जेलों में हैं. इनमें से ज़्यादातर की सज़ा भी पूरी हो चुकी है. यह लोग जुर्माना व ज़मानती न होने की वजह से जेल की चक्की पीस रहे हैं. जिस मामले में संजय दत्त को सज़ा सुनाई गई हैं, उसी आर्म्स एक्ट के मामले में अब तक (यानी 2011 के अंत तक) 2113 लोग देश के अलग-अलग जेलों में सज़ा काट रहे हैं. इसके अलावा आर्म्स एक्ट में कई सालों से अब तक 9038 लोग अंडर ट्रायल हैं. अगर आर्म्स एक्ट जैसे बड़े मामलों को छोड़ दिया जाए तो सिविल कैदियों की संख्या भी साल 2011 के अंत तक 123 है जो देश के अलग-अलग जेलों में सज़ा काट रहे हैं. वहीं 554 सिविल कैदी अंडर ट्रायल हैं. जबकि यह आंकड़ा सिर्फ 9 राज्यों का ही है. सिविल कैदी वो हैं जो अपने बच्चों का खर्च न उठा पाने, जुर्माना या हर्जाना न दे पाने, किसी की जमानत देने का बाद पैसा न चुका पाने या आरोपी के कोर्ट न पहुंच पाने या फिर कोर्ट का कहना न मानने के कारण जेल में हैं.

    नेशनल क्राईम रिकार्ड ब्यूरो से 2011 के अंत तक के प्राप्त आंकड़ों के मुताबिक हमारे देश में कुल 1382 जेल हैं. और इन 1382 जेलों में अधिक से अधिक 332782  कैदियों को रखा जा सकता है. लेकिन 372926 कैदी जेलों में अपनी सज़ा काट रहे हैं. साल 2011 में 1373823 अंडर ट्रायल कैदियों को रिहा कर देने के बाद भी 241200 यानी 64.7 फीसदी लोग अभी भी अंडर ट्रायल हैं. यही नहीं,  2450 लोगों को सिर्फ शक की बुनियाद पर गिरफ्तार किया गया है. इसके अलावा 1332 कैदियों की जेल के अंदर मौत भी हो चुकी है, जिनमें 1244 कैदियों की मौत प्राकृतिक मौत है बाकी 88 अप्राकृतिक मौत से मरे हैं.

    अब सवाल यह उठता है कि जिस देश में हजारों लोग सिर्फ ज़मानती न होने के कारण जेल में बंद हों उसी देश में संजय दत्त के लिए इंसाफ की आवाजें उठना क्या दोगलापन नहीं है. बेहतर होता कि हम पहले उन लोगों को न्याय देते जो पहले से ही जेल की चक्की पीस रहे हैं, उसके बाद किसी फिल्मी सितारे पर रहम किए जाने की बात करते.

    In his second letter to the Chief Minister of Maharashtra, Justice Katju expresses the notion of the country regarding the illegal arrest of two innocents whose liberty as at stake.

    Earlier today, Justice Katju sent an email to the state chief minister questioning the steps taken by the government against the delinquent police men. Chief Minister overlooked the mail and only forwarding it to someone Amitabh Ranjan without responding. This inaction has probably invoked justice katju to write another mail reminding him the seriousness of the matter.

    “You have not replied to my email but only forwarded it to someone called Amitabh Rajan, whom I do not know, and who has not had the courtesy to respond to me. Please realize that the matter is much too serious to be taken in this cavalier manner, because the principle of liberty is at stake. The entire nation wants to know what action you have taken. I would therefore request you to immediately let me know what you are doing in this matter,” states Justice Katju in his second letter to the chief minister of Maharashtra.

    The anger of the people on social networking site has succeeded in bringing the issue into the horizons of the mainstream media. The silence of Maharashtra government would certainly rise many questions and distrust among the netizen. One may or may not agree to the previous remarks of Justice Katju, but here he has raised a valid question of national concern.

    He additionally questions the Maharashtra chief minister that “Are we living in a democracy or not? How can a person be arrested for objecting to the shutdown in Mumbai on Thackeray’s death ? Article 21 of the Constitution, to uphold which you have taken an oath, states that no one can be deprived of his life or liberty except in accordance with law. Does Article 21 not exist in Maharashtra? Does freedom of speech guaranteed by Article 19(1)(a) also not exist in your state?”

    Dear Chief Minister,

    I am forwarding an email I have received stating that a woman in Maharashtra has been arrested for protesting on Facebook against the shut down in Mumbai on the occasion of the death of Mr. Bal Thackeray. It is alleged that she has been arrested for allegedly hurting religious sentiments.

    To my mind it is absurd to say that protesting against a bandh hurts religious sentiments. Under Article 19(1)(a) of our Constitution freedom of speech is a guaranteed fundamental right . We are living in a democracy, not a fascist dictatorship. In fact this arrest itself appears to be a criminal act since under sections 341 and 342 it is a crime to wrongfully arrest or wrongfully confine someone who has committed no crime.

    Hence if the facts reported are correct, I request you to immediately order the suspension, arrest, chargesheeting and criminal prosecution of the police personnel (however high they may be) who ordered as well as implemented the arrest of that woman, failing which I will deem it that you as Chief Minister are unable to run the state in a democratic manner as envisaged by the Constitution to which you have taken oath, and then the legal consequences will follow

    असम में हिंसा की ख़बर को भले ही मीडिया ने खास तवज्जों न दिया हो, लेकिन असम हिंसा को लेकर मुंबई के आज़ाद मैदान में होने वाले हिंसा की ख़बर को देश के तमाम मीडिया में अपने पहले पन्ने पर प्रकाशित की है. हालांकि ज़्यादातर हिन्दी अख़बारों में तथ्यात्मक गलतियां भी देखने को मिली, और अख़बारों की भाषा कुछ और ही बयान कर रही थीं.

    खैर, उर्दू के अख़बारों में यह मामला दूसरे दिन भी छाया रहा. जागरण ग्रुप का ‘इंकलाब’ अख़बार के संपादक (नॉर्थ) शकील शम्सी लिखते हैं कि “आज दुनिया भर में पुलिस एहतजाजी मुज़ाहरीन को मुंतशिर करने के लिए वाटरकैन और रबर बुलेट का इस्तेमाल करती हैं, लेकिन हमारे मुल्क में अभी तक इस बात की ज़रूरत नहीं समझी गई है कि भीड़ को मुंतशिर करने के लिए रबर की गोलियां चलाई जाएं. बहुत से लोगों का कहना है कि पुलिस के ज़रिए गोली चलाए जाने से हालात ज़्यादा ख़राब हुए. सच क्या है, ये तो जांच के बाद ही सामने आएगा, लेकिन अफ़सोस कि दो नौजवानों की जान चली गई.”

    ‘हिन्दुस्तान एक्सप्रेस’ अपने संपादकीय में लिखता है कि “हम ये ज़रूर कह सकते हैं मुम्बई की पुलिस फायरिंग का ये वाक़्या जम्हूरियत के माथे पर एक कलंक का टीका ही है, जिसे मिटाना लाज़िमी है. ये इस वज़ह से ज़रूरी है, क्योंकि अगर हुकूमतें खामोश रहीं तो पुलिस का हौसला और बढ़ेगा और ये तास्सूर भी आम होगा कि सरकारी मिशनरी अल्पसंख्यकों पर ज़ुल्म ढ़ा रही है, जिस पर हुकूमत खामोश है!”

    ‘हमारा समाज’ अपने संपादकीय में लिखता है कि “सच्चाई ये है कि हिन्दुस्तान जैसे अज़ीम और सेकुलर मुल्क में हर रोज़ कहीं न कहीं अल्पसंख्यकों की जान व माल की हिफाज़त में कोताही हो रही है. लिहाज़ा हुकूमत को चाहिए कि इंसाफ करे.क्योंकि जिस मुल्क के अल्पसंख्यक इस मुल्क से खुश हो, जिस मुल्क में अल्पसंख्यकों को इंसाफ मिले, वो मुल्क दुनिया में अज़ीम कहलाते हैं. लेकिन हिन्दुस्तान में जम्हुरियत पर कब कौन सा लीडर डाका डाल दे, ये कहना बड़ा मुश्किल है. क्योंकि गुज़िश्ता रोज़ का का वाक़्या है कि एहतजाज करने वालों पर पुलिस ने बग़ैर वार्निंग के गोली चला दी, हालांकि वार्निंग देना बहुत ज़रूरी था, मगर ये मुसलमान थे जिनको वार्निंग कभी नहीं दी जाती, बल्कि इनका इस्तकबाल डायरेक्ट पुलिस की गोली करती है.”

    ‘राष्ट्रीय सहारा उर्दू’ अपने संपादकीय में लिखता है कि “मुसलमानों में इसलिए भी रंज व ग़म की लहर दौड़ी हुई है कि वज़ीरे-आज़म डॉ. मनमोहन सिंह अमेरिका के सिक्ख गुरूद्वारे में हमारे 6 सिक्ख भाई-बहनों के क़त्ल पर तो फोन उठाकर सदर बराक ओबामा से बात कर सकते हैं, लेकिन म्यांमार में मुसलमानों के कत्ले-आम पर वहां के सदर या वज़ीरे-आज़म सरज़िन्श नहीं कर सकते.”

    ‘सहाफ़त’ के संपादक हसन शुज़ा अपने विशेष संपादकीय में लिखते हैं कि “आज भी कई टीवी चैनल ये बता रहे हैं कि 6 हज़ार बांग्लादेशी रोज़ मुल्क में दाख़िल हो रहे हैं. अगर ऐसा है तो इन लोगों को सरज़मीन-ए-हिन्द में दाख़िल होने से क्यों नहीं रोका जा रहा? सरहदों पर ज़बरदस्त पहरा है. सिर्फ एक दरियाई रास्ता है, वहां भी काफी फौज पुलिस तैनात रहती है. फिर इतना बांग्लादेशी आने की ख़बरें क्यों आ रही हैं? आसाम में क़त्ल, फ़सादात और इंसानी जान व माल के ज़यां से कहीं बेहतर ये होगा कि हस्बे क़ानून जो लोग बांग्लादेशी साबित हो जाएं, उन्हें वापस किया जाए. और लोगों को आने से रोका जाए, लेकिन जो ग़ैर-आसामी, ग़ैर-बोडो हिन्दू मुसलमान बंगाली हिन्दुस्तानी शहरी हैं, उनकी ज़िन्दगी दुश्वार न बनाई जाए. सरहदों पर सख्ती बरतना कोई बहुत बड़ा काम नहीं है, लेकिन ग़ैर-मुल्की के नाम पर आसाम में मुसलमानों को हरासां करना ग़लत है. ”

    इस बीच ख़बर यह भी है कि बरेली में फिर हिंसा भड़क उठी है. 15 लोग ज़ख्मी हुए हैं.  फिलहाल स्थिति नियंत्रण में है.

    Dear Sir,

    We, citizens of India committed to its deep secular and peace loving ethos appeal to you as head of the government in Assam to take all steps to ensure that violence stops, security is given to all displaced and dishoused by the violence so that they may return to their homes forthwith; adequate reparation for the lives lost and homes and other properties destroyed is paid and more than anything else a Fair and Time Bound Judicial Investigation by a Sitting HC Judge is conducted into the build up and fallout of the violence.

    What concerns us deeply is the divisive discourse that seeks to create legitimacy for the violence by words and phrases like “infiltrators.” Since the mid 1990s tensions have simmered between the majority Bodo Councils and Muslim settlers despite the fact that the latter status was recognised in the Assam accord. Yet under the guise of discriminating between the two a small skirmish blew into a full blown communal conflagration; while the ethnicity of the 32 persons who lost their lives does not matter, the fact that the five persons who lost their lives to police bullets are from the minority has generated fear. There are already 1,70,000 persons in relief camps and they must be assisted with due security to return to their homes immediately. Dialogue must begin between the majority Bodo villages and the Muslim settlers for integrated rehabilitation.

    Citizens appeal to PM, CM: Save Soni Sori from Death in Jail

    In an open letter addressed to the Prime Minister of India and other officials, about 250 concerned activists, academics, intellectuals, students, professionals and democratic organisations have demanded immediate medical attention for the Adivasi school teacher, Soni Sori, 35, currently in custody in Raipur Central Jail, Chhattisgarh.  Soni Sori’s condition is believed to be rapidly deteriorating as a result of torture and sexual abuse at the hands of the Chhattisgarh police. She is the mother of three young children. Signatories to the letter include members of the National Advisory Council Harsh Mander and Aruna Roy, writers Arundhati Roy and Meena Kandasamy, respected economist Jean Dreze, Supreme Court advocate Prashant Bhushan and renowned intellectual Noam Chomsky.

    In a recent medical report, doctors found stones inserted in Ms. Sori’s genital tract and rectum, and in a letter smuggled out of the prison, Ms. Sori states that she was stripped and electrocuted during police interrogation.  Meantime, she received none of the follow-up medical treatment that she badly needs.

    More than six months after she was tortured, Sori continues to be imprisoned in Chhattisgarh and has received virtually no follow up medical treatment for the injuries she sustained in police custody and the infections that have developed as a consequence.

    No investigation or action has been initiated against the police officers responsible for her torture. On the contrary, Superintendent of Police Ankit Garg, named in Sori’s letters, was awarded a Gallantry Medal on Republic Day, 2012. Sori’s petition before the Supreme Court asking to be transferred out of Chhattisgarh has been subjected to repeated delays and is still pending. Her health continues to deteriorate in the meantime.

    We, the undersigned, are deeply concerned by the rapidly worsening health of Soni Sori in Raipur Central Jail. She has been passing blood with her urine, is having difficulty to sit or get up, and has lost considerable weight. Despite doctors from NRS Medical Hospital having confirmed that stones had been inserted into her vagina and rectum, Soni Sori has received no proper medical attention. We fear for Soni’s life and are outraged and ashamed at this inhuman treatment of a woman in India.

    Soni Sori, 35, is an adivasi school teacher from Dantewada who was arrested in New Delhi on Oct 4 2011. Six months have passed since Soni was tortured physically and sexually but neither the state nor the central government has investigated the abuse. Her case has been repeatedly listed up in the Supreme Court but has been postponed every time. Throughout the duration of Soni Sori’s imprisonment, the state has also tried to stifle her communications with the civil society. In January this year, a team from various women’s groups across the country went to Raipur Jail to meet Soni, but they were prevented from doing so by the administration.

    The brutal treatment meted out to Soni Sori, and the prevailing situation of conflict and repression in Chhattisgarh, cause us grave concern about Soniin particular, and the situation of women prisoners, in general. We demand immediate access for fact-finding groups to meet with Soni Sori and others to assess their condition in jail, particularly their medical situation. We fear that Soni Sori’s condition is rapidly deteriorating, and demand that she receive immediate medical attention.

    Thackeray Saheb! Chhatrapati Shivaji Airport is now PRIVATE Property of GVK Reddy of AP. Still your ‘Marathi Pride’ is not awakened?

    Have you recently heard any jokes about selling Taj Mahal to foreign tourists? No? Not lately? That is because people don’t joke about that nowadays. Do you want to know why? Because today, the situation is such that some influential people can truly sell the Taj Mahal to a foreign tourist. Or, to putting it in the terms that Mumbai public will understand, it is quite likely that Mumbai’s beloved Shivaji Maidan will soon be sold to a consortium of private companies and foreigners, and the Mantralaya building will be given as a free gift. To avoid causing alarm to the common man, they will call it ‘Public Private Partnership’ or PPP.

    Without a clear-cut PPP policy and without regular audits by Comptroller and Auditor General (CAG), India’s public property is being carved up and sold like a beef cow. The government’s butchery and sale of India’s assets is couched in PPP terminology like modernization of infrastructure, special purpose vehicles, etc. etc.

    A TWISTED LOGIC OPERATES IN PPP: On the one hand, the government lavishly gives the private partner public resources worth thousands of crores of rupees, ostensibly because the private partner is supposedly maintaining a PUBLIC INFRASTRUCTURE. On the other hand, the private partner is free to avoid being questioned and to seek undue profits as he argues (and the government agrees) that this is a PRIVATE ACTIVITY.

    HOW CAN BUILDING AND MAINTAINING PUBLIC INFRASTRUCTURE BE A PRIVATE ACTIVITY? HOW CAN ANY SUCH INFORMATION BE ‘PRIVATE’ OR ‘CONFIDENTIAL’? Don’t ask, because this twisted logic is an accepted part of PPP projects.

    “LALOO YADAV RAILWAY STATION IN MUMBAI” — True or False? False, because it hasn’t happened yet. But consider this scenario three years hence. The year is 2015. Patna-based Laloo Yadav & Sons Ltd (LYSL), in collaboration with a consultant company called Pirates of Somalia Ltd, newly registered in Mauritius, takes over the railway station called Chhatrapati Shivaji Terminus (CST) in Mumbai. The Railway Ministry transfers CST’s heritage building and all surrounding railway lands to LYSL on a 30-year lease for only Rs 100 per year. LYSL in turn transfers this land to a subsidiary company. This subsidiary company uses it as security to take an “infrastructure loan” of thousands of crore rupees from a consortium of public sector banks. Hotels and commercial spaces start sprouting on the railway land. Pirates of Somalia Ltd. periodically sends technical consultants who freely travel throughout the railway system, and nobody has the authority to question them – not even the railway ministry.

    Worried about national security and public property, citizens file RTI applications questioning this activity. Laloo Yadav & Sons says, “We are not part of the government, and so we are not under RTI. We are a private company, this is a private for-profit activity.” Central Railways and the Union Railway Ministry don’t answer queries, saying that only Laloo Yadav & Sons has the answers. Finally, in 2016, Chhatapati Shivaji Terminus is officially renamed as ‘Laloo Yadav Railway Station’.

    Is this a far-fetched scenario?

    Now consider another scenario: “GVK REDDY AIRPORT IN MUMBAI” — True or false? True. It has already happened. Except for the renaming, everything else mentioned in the previous scenario has already happened to MUMBAI’S CHHATRAPATI SHIVAJI AIRPORT. Mumbai’s airport has been the PRIVATE ‘JAAGEER’ OF GVK REDDY OF ANDHRA PRADESH for 4-5 years now. While the UPA government seems happy with this situation, the common man is fighting in court.

    Airport Authority of India has 26% stake, and GVK Airport Holdings Pvt Ltd holds about 51% in a consortium called Mumbai International Airport Limited (MIAL). The remaining 23% shares are held by two khokha companies registered in Mauritius, whose relationship with two similar-sounding South African infrastructure companies is being actively concealed by Govt. of India. In GVK’s annual reports, MIAL is called an “associate company”. The language of the annual reports indicates that the accounting treatment of MIAL IS LIKE A GVK GROUP SUBSIDIARY COMPANY rather than as a public sector entity in which GVK is a private sector partner.

    While enjoying 2000 acres of AAI land for a lease rent of Rs 100 per annum, and paying ridiculously low Income Tax and Service Tax of around Rs 3,000, GVK claims the freedom to act as if it is just another private limited company working to maximize profits. It is running MIAL in collaboration with the two khokha companies – namely ACSA Global Ltd. and Bid Services (Mauritius) Ltd — which have shadowy links to the companies that were evaluated by Airport Authority and found worthy to be partners in the MIAL Consortium, namely Airports Company South Africa and Bidvest of South Africa.     In June 2008, a BOMBAY HIGH COURT RULED THAT MIAL IS AN INSTRUMENTALITY OF THE ‘STATE’. BUT GVK STILL REFUSES TO ADOPT STANDARDS OF TRANSPARENT DEALING that come with being an instrumentality of state, and a custodian of state properties. What is alarming is that Govt of India is quietly playing along with GVK.

    To shield GVK and the khokha companies, even public authorities such as Airport Authority of India (AAI), Union Aviation Ministry, Finance Ministry, Airports Economic Regulatory Authority (AERA), Planning Commission and other government bodies that are privy to MIAL’s dealings are continually evading RTI queries.     A consortium of banks gave an infrastructure loan of Rs 4200 crore of public money to MIAL. Whose money? Yours and mine. But the details are being concealed by the banks. In a worryingly perverse order, Central Information Commissioner Shailesh Gandhi opined that it was a matter of “commercial confidence and fiduciary relationship” between the banks and the borrower, and there was no public interest in our knowing about it: http://tinyurl.com/ShaileshGandhi-MIAL-Order-2012

    MIAL is part of a dangerous trend of private parties snapping up public resources and taxpayer’s money. We the People need to recognize the seriousness of this problem, and counter it before it is too late.

    HOW GVK IS ABUSING THE JUDICIAL PROCESS TO CAUSE DELAYS

    The question of whether MIAL is a public authority (i.e. answerable under RTI Act 2005) was decided by Bombay High Court in Writ Petition No.617 Of 2007. The judgment dated 5th June 2008 said, “the issues which arise for consideration in the present Writ Petition are: (i) Whether the Respondent No 3 Company, MIAL, is ‘State’ within the meaning of Article 12?” On page 170 and 171 of the judgment, after lengthy reasoning, Bombay High Court concluded, “It is because Respondent No.3 performs Governmental functions that… it can just like Government use a summary procedure to evict unauthorized occupants on the area leased to it without following the rigor of the Rent Act.     The question of whether MIAL was a public authority as per RTI (which is the same as being “State” under Article 12 of the Constitution) was simultaneously considered and answered by the Central Information Commission in June 2008. The CIC ruled that MIAL, like its counterpart DIAL (Delhi International Airport Ltd) is a public authority, and therefore directed it to furnish the information requested under RTI. But MIAL did not want to comply. As this matter had already been decided by Bombay High Court, MIAL DID NOT HAVE THE OPTION TO APPEAL BEFORE BOMBAY HIGH COURT. SO IT WENT TO DELHI HIGH COURT and pleaded that its submissions had not been heard by CIC. (This unlawful behavior is called forum-shopping — actively seeking a court that might give a favorable judgment.)

    Delhi High Court asked CIC to re-hear the case.  CIC RE-HEARD THE CASE. IT’S VERDICT WAS THAT MIAL IS DEFINITELY A PUBLIC AUTHORITY as per section 2(h), and therefore, it must give information requested under RTI. CIC order dated 30th May 2011: http://tinyurl.com/CIC-MIAL-Order-2011

    WHY ARE OPPOSITION PARTIES SILENT?

    The Congress-led government is doing its best to cover up the loot. But We ask the self-appointed guardians of Marathi pride – namely, Shiv Sena and Maharashtra Navnirman Sena — why they are letting the government get away with it? Are the Sena-led trade unions at the airport not keeping them informed about the daylight robbery of Mumbai’s most prestigious international asset by these thugs from Andhra Pradesh, South Africa and God-knows-where-else? Is the pride of the ‘Marathi manoos’ not injured by this motley bunch looting Chhatrapati Shivaji Airport where a giant statue of the great Maratha warrior was proposed to be installed?

    MARATHI PRIDE? WHAT MARATHI PRIDE? The silence of two Senas makes us question whether the Marathi asmita is only a ornamental showpiece, like the manly turbans that are worn only for watching Lavani dancers perform, and not for any real act of manliness and courage.

    Mumbai: Few days ago, the city observed builder Lalit Gandhi’s second death anniversary. Gandhi, co-founder of Lok Group, passed away on 23 March 2010. He had seen visions of innovatively making money from the dilapidated ceased buildings of Chira Bazaar in South Mumbai. In 2006-07, he founded an NGO called Remaking of Mumbai Federation (ROMF).

    This NGO was spearheaded by Mayank Gandhi, Shri Lalit Gandhi’s charismatic nephew (who went on to achieve national fame last year as a major architect of Anna Hazare’s India Against Corruption campaign). By fudging the lines of demarcation between commercial interest, private interest and public interest, this NGO merged Lok Group’s commercial interest with the ambition of over 8000 tenants living in dilapidated buildings to have better homes. By connecting with the Mumbaikar’s desire for a beautiful city, Remaking of Mumbai Federation (ROMF) became a media-darling and messiah of Chira Bazaar Cluster Development. It organized several events.

    Around the core of these events, a publicity campaign consisting of systematic misinformation and name-dropping was built. Sri Sri Ravishankar, Justice P N Bhagwati, Narayan Murthy and Deepak Parekh, Citispace are a small sample of the dignitaries whose names were exploited for creating brand-equity around ‘Remaking of Mumbai’. The credits-list of this newsletter is a good specimen of such name-dropping.

    Contrary to the public perception that was created, there was nothing “inclusive” about Remaking of Mumbai Federation. It was never a true federation of stakeholders, and it never gained the grassroots level support from landlords and tenants of Chira Bazar. The couple of tenants associations supposedly supporting ROMF were little more than letterheads.

    To Lalit Gandhi’s Lok Group-the owner of this NGO-Chira Bazaar Cluster Development was a cash cow to be carved up into beef and sold to the highest bidder. Had things gone according to plan, Lok Group might have reaped bumper profits by selling it for at least Rs 37.5 crores, if not much more.

    Under the heading, ‘Cancellation of earlier MOUs and Agreements’, this document refers to an earlier transaction worth Rs 37.5 crore in August 2010, in post-dated cheques dated from November 2010 till end-2013. ROMF had claimed that it would deliver the Chira Bazaar cluster development project, tied up neatly, to Unity Developers. (Unity Infraprojects Limited (UIL) is the holding Company of Unity Realty & Developers Ltd – the buyer of this project.  The promoters of UIL- K K Avarsekar and his associates – are known to have the blessings of the Thackeray family; this may explain the eagerness of MCGM’s High Powered Committee to overlook the glaring shortcomings of this project.)

    So, in effect, this present agreement, which scaled down the payment to Rs 10 crore, was an admission of ROMF’s inability to deliver as promised.

    As per the present agreement made in Jan 2011, Lok Group and ROMF sold a 5 acre “pilot project” carved out of this 30-acre project to Unity Realty & Development Ltd (URDL) for down-payment of Rs 5 crore, plus Rs 5 crore linked to the project progress. Under the heading, ‘Monetary Obligations & Considerations’. (Incidentally, this deal was transacted on stamp paper of Rs 100. Stamp duty of 5% of value of immovable properties / land / development rights was not paid on this Development Agreement. If we take the deal at its face value – Rs 10 crore – it amounts to stamp duty evasion of about Rs 50 lakh. But some experts feel that the true value of this agreement is far beyond these figures; even under the scaled-down agreement, ROMF was delivering to Unity Realty an intangible asset worth hundreds of crores. One way or another, it is a huge evasion, and Maharashtra Stamp Duty department should estimate what its true value is!)

    In this agreement, the seller is ROMHIF. So what is the connection of ROMHIF with ROMF? This extract from Lok Housing & Constructions Ltd Directors Report 2010 explains it: “Remaking of Mumbai Housing Infrastructure & Finance Ltd” (ROMHIF) submits proposal for Chira Bazaar Cluster redevelopment in C Ward of Mumbai. The High Powered Committee clears Chira Bazaar Cluster redevelopment proposal of ROMHIF to redevelop around 30 acres of land (362 buildings and over 8000 tenements). The proposal for demolishing of old and dilapidated structures and construction of high rise buildings is under consideration with Government of Maharashtra. ROMHIF has submitted its proposal to redevelop around 30 acres of land (362 buildings and over 8000 tenements) in the Kalbadevi-Chira Bazar area in C Ward. It proposes to demolish these old and dilapidated buildings and in their place construct high rise structure in the ear-marked plots. Lok Housing Ltd has 49% stake in the shareholding of Remaking of Mumbai Development Ltd. (ROMD) which is the holding Company for ROMHIF”. As per the website of Registrar of Companies, the registered Addresses of both ROMD and ROMHIF is Lok Bhavan, Andheri East, Mumbai. Paid up capital of ROMD and ROMHIF is Rs 40 lakh and Rs 5 crore respectively.

    Since Lok Housing Ltd as per Directors Report has 49% stake in the holding company ROMD for ROMHIF, who owns the balance 51% stake?  Is it somebody in the government or civic administration? We don’t know, but it will be interesting to find out.

    The names of all companies start with Remaking of Mumbai. Why? So that the brand equity of ‘Remaking of Mumbai’ can be effortlessly passed on to any buyer. The government approvals gotten by ROMF can also be transferred, with some help from pliant government officials, to another entity with the same name, namely Remaking of Mumbai Unity Developers Private Limited. In this crucial clause, the agreement recognizes that it is crucial to retain the ‘Remaking of Mumbai’ name at all times, even if the latter part of the name were changed in future i.e. if Unity Realty & Developers sold its stake to someone else. (Now that is like saying: Smita is married to Ramesh. It is crucial that any man desirous of sleeping with Smita must knock on the bedroom door and say, “Open the door, I am Ramesh.” Needless to say, the real Ramesh gets paid.)  

    Unfortunately for Lok Group and their buyer, Unity Realty, the state government questioned the fraudulent claims of Lok Group/ROMF – especially the claim that that it had written consent from 79.2% tenants. What it actually had was some letters from a small number of tenants, giving the project their best wishes without even knowing the particulars of the project – and of course, without knowing even which builder was going to undertake the massive redevelopment, and whether he had the capital and infrastructural capabilities to do so.

    The state government pulled up MCGM’s high-powered committee for not exercising due diligence.

    To some activists, the design behind Remaking of Mumbai Federation was clear from the start. UTSAL KARANI AND HIS COLLEAGUES AT JANHIT MANCH blew the whistle on Lok Group and ROMF several times, until Chief Minister Prithviraj Chavan and Municipal Commissioner Subodh Kumar finally opened their eyes.

    We need to remember that builders can create a marketable asset without having anything in hand, just like magic. We must remember that builders will always find innovative ways of bypassing the processes of competitive bidding and project evaluation by whipping up public sentiments. On this solemn occasion of Shri Lalit Gandhi’s second death anniversary, let us all maintain one minute’s silence and remember how Lok Group and Remaking of Mumbai Federation nearly pulled a fast one on this city.
