26/11 Probe: Why Judiciary Also Failed?

A brief note on the book by Sachin Godambe

The author of the well known book, “Who Killed Karkare?”, Mr. S.M. Mushrif , former I. G. Police, has penned another book “26/11 Probe : Why Judiciary also failed?” on the same subject.

Mr. Mushrif has written this book on the basis of irrefutable pieces of evidence such as the depositions of the prosecution witnesses in the court, some important remarks of the judges in the judgments, the footage of the incidents telecast live or 26-11-probe-mushrif-8172210620immediately after their having taken place during the night of 26-27 Nov 2008 and some other authentic documents.

He has claimed in the book that almost all the important incidents, especially in the CST-Cama Hospital-Rangbhavan (G.T. Hospital) lane part of the attack and those concerning the Girgaum chowpatty encounter were suppressed and a totally false picture was projected before the public by pressuring and/or misguiding the media. The media were made to black out some important events and to publish the false police story repeatedly. The author has further contended that the courts were also misguided by hiding facts from them or were subjected to psychological pressure by incessant false propaganda and were made to commit many procedural lapses, technical errors and/or acts of omissions or commissions.

In support of his contention, the author has enclosed a DVD in the book. The DVD contains some TV footages which totally contradict the police theory and also the footages of some other incidents which have been totally blacked out by the police and hence did not find place in the chargesheet of the case.

Moreover, a Public Interest Petition demanding the re-investigation of the Mumbai attack case has been pending in the Bombay High Court for over three years. The PIL was filed by Mr.Radhakant Yadav, a veteran socialist leader from Bihar in July 2010 on the basis of the theory propounded by the author in his first book “Who killed Karkare?”

The court after applying its mind issued notices to the respondents on 17th August 2010 and directed them to file their reply within 4 weeks. More than three years have passed, but so far neither the Govt. of India nor the Govt. of Maharashtra has filed the affidavit-in-reply. In normal circumstances, the court would have drawn adverse inference and decided the case in petitioner’s favour. But it was not done in this case and the petition has been allowed to linger indefinitely.

The author has held the IB, the country’s premiere intelligence agency responsible for misleading the court by suppressing relevant facts and stopping it from issuing order for re-investigation of the case. According to him, the IB has been doing so in order to keep away from the public eye its many Himalayan blunders, the gravest being the act of suppressing the absolutely specific information of the LeT’s Mumbai attack, which it committed to eliminate Hemant Karkare as he had been bent upon exposing its dubious role in the anti-national conspiracy of Abhinav Bharat to destabilize the present democratic system and the Republic.

Mr. Mushrif has also indicted many high profile persons like the Ex.Union Home Minister Mr.P.Chidambaram, the then National Security Advisor Mr. M.K.Narayanan, the then Union Home Secretary Mr.Madhukar Gupta, the then IB chief Mr.P.C.Haldar, the then DGP Maharashtra Mr.A.N.Roy, the present DGP Maharashtra Mr.Sanjeev Dayal and the Senior Special Public Prosecutor Mr.Ujjwal Nikam for shielding the real culprits by deliberately suppressing the facts and/or presenting a false story to the public and/or to the courts.

In the book, the author has expressed serious concern over the unbridled powers being enjoyed by the IB, an extra constitutional authority, to the extent of influencing almost all our constitutional institutions.

However, he has ended the book on an optimistic note – pinning his hopes on the judiciary.

The book was released on 14th Jan. 2014 at Press Club, Mumbai at the hands of Hon’ble Admiral (Retd.) Vishnu Bhagwat and Income Tax Commissioner, Mumbai Mr. Subachan Ram.
