It’s been five year since Ms. Shamim Modi, an assistant professor with TISS, Mumbai, and a known social and political activist became victim of a brutal attack, but alas she still awaits justice from the Mumbai High Court. After CB, CID Mumbai Crime Branch failed to solve the conspiracy, as dictated by the Mumbai High Court in its earlier order of October 2010, Ms. Shamim Modi, through her lawyer Mihir Desai, has approached the Mumbai High Court. But the court is yet to act on her four year old writ petition no 2545/2010, in which she has demanded a CBI investigation against the ex-Revenue Minister of Mr. Kamal Patel of BJP, who belongs from Madhya Pradesh and his business associate Natwar Pate for hatching out the plot. The enquiry has also been requested against the then Senior Police Inspector of Manikpur Police Station of Vasai; district Thane, Mr. Ashok Pawar for his involvement in the crime, under whose jurisdiction the criminality occurred.
She was attacked by the watchman of her building in her flat in Vasai on 23rd July 2009. She received 118 stitches all over her body, with her skull being fractured, her throat being slit. Had the cut been deeper, she would not have survived the gruesome ordeal, as stated by the treating doctor Prakash Shinde in the injury certificate. Yet the case of attempted murder was registered only on the intervention by the Mumbai High Court in her petition of October 2009 and the investigation was entrusted to CB CID, Mumbai crime branch. Despite all their best efforts, the CB, CID, unit 12, Dahisar, has failed to investigate the case.
During her social and political work back in M. P from 1994 to 2009 she had organized Adivasi and other industrial labors, also exposing the corrupt nexus of the Minister in question Mr. Kamal Patel. She has also demanded investigation into the involvement of the then Senior Police Inspector of Manikpur Police Station of Vasai, district Thane, Mr. Ashok Pawar, as he had not only motivated the dishonest and deliberate nature of the investigation, but had also manipulated evidences since the time of registration of the FIR. He destroyed the most vital forensic evidences, and shrewdly fabricated the entire incident as a mere “robbery attempt”. As part of the evidence and protocols, he did not seize the nightgown worn at the time of attack, which was soaked in the petitioners blood instead he “seized” a Salwar Kurta on record and showed her wearing that at the time of attack, manufacturing fake evidence to prove “robbery attempt”. The facts and circumstances indicate a larger political conspiracy.
Brief Introduction:
After completing her graduation in psychology from Jesus and Marry College, New Delhi, she got her Master’s degree in psychology from Lady Shree Ram College, New Delhi, Master of Philosophy (M. Phil.) in Social Psychology from the prestigious Tata Institute of Social Science, Mumbai and L.L.B. from Barkatullah University, Bhopal. She later given up her carrier and based herself upon the Gadhian Principals, initiated grassroot level work in M.P with her husband Anurag Modi. The couple along with local tribals of Betul district and with the active support of Tata Institute of Social in 1996 formed an organization called Shramik Adivasi Sanghthan (SAS), which in the last 13 years has expanded to Harda and Khandawa Districts of MP. She fought many elections, few against the said minister on the ticket of Samjwadi Jan Parishad, a rather small and unknown outfit launched by the veteran socialist and close associate of Lohia, the Late Kishan Patnayak.
